I interested in purchasing a nice custom kubaton to play with and carry. But Im unsure whether I can legally carry it or not. I don't wanna buy another desk toy...:o

Why spend the money on a custom job? The standard Monadnock Lifetime Products model Kubaton is made from indestructible Monpac plastic with your choice of colors or grooves/no grooves and a keyring. Don't pay any more than $5.00 or $6.00 for one. A six-inch length of broom handle will serve the same function and can be had for less than a dollar.

They are too short in my opinion to be a "billy," and lack the flexibility of a blackjack (both are prohibited). But the law is hazy and no definitive answer exists. Individual officer and situational judgement are what matter. A kid once complained that his crowbar was taken from him because he made the mistake of saying to the police it was to protect him from a neighborhood pitbull that bit him the previous week.

That being said, a kubaton is a 6-8 inch cylinder. Pretty generic if you think about it. Lots of mundane objects can fill that job.

In answer to your question, I looked in the Penal Code recently, and to the best of my opinion plastic and wood kubatons of normal dimensions are still legal to carry. Metal ones are not. (As others have pointed out, however, a normal metal pen or flashlight is not a kubaton.) YMMV.

Best regards,
