SENATE, No. 1384

By Mr. Shannon, a petition (accompanied by bill, Senate, No. 1384) of Charles E. Shannon, Timothy J. Toomey, Jr., David P. Linsky and Paul J. Donato for legislation relative to the possession of a machete. Public Safety and Homeland Security
The Commonwealth of Massachusetts
Seal of the Commonwealth of Massachusetts
In the Year Two Thousand and Five.
AN ACT RELATIVE TO THE POSSESSION OF A MACHETE

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.

Subsection (b) of section 10 of chapter 269 of the General Laws, as appearing in the 2002 Official Edition is hereby amended by inserting after the word “inches”, in line 67, the following word:- , machete.

SECTION 2. Said subsection (b) of said section 10 of said chapter 269, as so appearing, is hereby further amended by adding the following paragraph:-

For purposes of this section, “machete” means “a heavy knife at least 18 inches in length and having a blade at least 1.5 inches wide at its broadest measurement. This subsection shall not apply to carrying a machete on one’s person or in a vehicle if the machete is carried for the purpose of cutting vegetation or if the machete is being transported for the purpose of cutting vegetation. In a prosecution of a violation of this subsection, there shall be a permissible inference that such carrying of a machete is not for the purposes of cutting vegetation. Such presumption may be rebutted.

Any individual who requires a machete for the purposes of cutting vegetation shall register the machete with the local police department on an annual basis and, upon payment of an appropriate annual registration fee as determined by the local granting authority, shall be issued a permit authorizing him to possess the machete solely for the purposes of cutting vegetation.

Right to bear arms ...

Why doesn't US law consider an edged weapon every bit as much an "arm" as a firearm?

Does the State of MA. have infinite time, money and men to determine vegitation cut by large knives?

Notice the presumption of guilt?

This law could start a cutlery version of the "assault rifle" controversy. It covers all the larger khuks, goloks, parangs, bolos, barongs, etc., etc.. Hope we don't go the way Australia appears to be headed.:thumbdn:

Makes you want to go grab a piece of flashing coming off of someones roof and go kick their A**.

presumption of use beyond anything legal and lawful might be grounds for making the bill fail, and definitely fighting the law otherwise.

i'm sure they'll require all machetes to have a big, dated, registration sticker on them :>

the annoying part of the bill is also that dulled performance blades (for juggling) are not "not allowed", as are lawnmowers :)

i guess one 1.49999 inches wide would not require a permit, etc...., stupid law, musta been written by an exceptionally stupid lawyer.

In protest, every single one of us should now go out and purchase a fine machete. Spread the word to all your loved ones and friends..... Go out and purchase machetes ;)

I was just poking fun the other day (on another khukuri forum) on how funny it was that Lawn Jarts had gotten banned from manufacture or sale in the U.S..

It just get's worse every day! :(

He doesn't mention anything about "sawed off machetes." That deadly danger is easily concealable.

Perhaps they're next.

i'm investing in a 17.9 inch long x 1.49999 wide machete factory in boston. could catch on...

sounds like the f#@%*ing UK! that "shall register the machete" bulljunky is utter horsehooy! what next? UK style blunt kitchen knives?? :grumpy:

I've got a pre-ban Cold Steel machete here in near mint condition. I'd be willing to let it go for $200, sheathe included.

;)

Stamp act? Tea Tax? Machete fee? There was a time when such crap wouldn't fly with folks from Massachusetts. Hey you bedwetting, liberal, Massachusetts politicians, come on down south and try yer damn foolishness. Old Thumbcutter's got something fer ya. :grumpy:

Sarge

Here in Kalifornia its illegal to have a machete with a bayonet mount. Wait, I'm getting confused. But I reckon it makes about as much sense!

I hope those morons don't give the politicians here any more great ideas. They already restrict damn near everything. Schwartznegger just overturned a law that prevented counties and towns from making "breed specific" bans on dogs. I am afraid that I will not be able to own my bull breeds anymore:grumpy:  What is this country becoming? How come more people don't pay attention and vote these power hungry, "save us from ourselves" idiots out of office?

Guess it's time to drill holes in my khuks and convert them for lawnmower use. Anybody got a drill bit?

Maybe the old bait and switch: "You are in danger from (insert threat du jour here: jews, christians, muslims, aliens, werewolves, whatever). You can't take care of yourself. You need us."

And then you wake up with no more security than you had before, and a whole lot less ability to provide it for yourself when it becomes necessary.

Scared AND lazy is a dangerous combination in a populace. History is full of these scenarios.

Not worried. They have to prove that you wanted to use it for purposes other than cutting vegetation. I dont know many people that carry 18"+ blades that are 2" wide for other purposes, do you?

I dunno....i dont really feel too badly about this one the way its phrased
