More New York State Shipping Issues

I was just browsing True North Knives and noticed their shipping notice. More dealers not shipping to New York State? I thought it was New York City that had the issues, and even then only with some knives.
 
Maybe some people can't tell the difference between NY and NYC ! Happens a lot. I have a Benchmade backorder from REI and no comment was made about my NY address.
 
it is some politician in nyc! But the online dealers are just being cautious for now! Give it time! Funny you can order a 12" butcher knife but not a swiss army knife!? wtf right!

I haven't notice any issues with other dealers in recent history (Tom from spydercovt.com, CRK) but first I noticed Emerson; worrisome but not a direct impact on me, and now True North knives; worrisome and I was thinking about a purchase.
 
The issue is the NYC DA is using the STATE law as his basis for action. We disagree with his enforcement, but it is the NYS law he is using, therefore any other NYS DA "could" think the same way at any time....
 
Neil at TNK is a very smart man. He knows the difference between NYC and NYS and must have a good reason for this policy.
 
This has been discussed quite a bit on other threads. The New York City DA has been prosecuting NYC retail companies for selling liner locks. If I remember right the New York State law says any knife that can be opened by centrifugal force (aka flicked open) is considered a gravity knife. Gravity knives are illegal in NYS.

Anybody with a third of a brain can tell that a liner lock is not a gravity knife. But unfortunately this will likely have to go to a few court cases before this "hysteria" is over. IMO eventually this will be shot down in court at some time.

Many retailers are afraid that some other DAs besides NYC will start to "consider" a liner lock a gravity knife. Its a lot easier to be safe than sorry, unfortunately.
 
Is possession against the law or just to carry? Like an auto I thought you could own as a collectible just could not carry.

Tom19176 could answer these better than anybody. I haven't heard anything about an automatic being legal in New York except for one unusual exception.

An automatic knife is legal in NYS for hunting, as long as you have a valid hunting license. But you can only possess it on your person while you are hunting or to and from. You can't just have a hunting license and walk around town with a switchblade.
 
In NY State, they are illegal to own, carry, sell, transfer, borrow. The only exception is for Police officers, peace officers, and those who possess a fishing, hunting, trapping license for use while enaged in those activites. There is no size that is allowed, nor is their a one arm man exception. It was basically a grand fathering of knives owned when the law was passed to allow the sporting use and possession of them, but the wording allows for you to own them and use them for those purposes with a valid license.

The issue is that it takes a good deal of money to go to court. Knife Rights is working on this, BUT it takes a LOT OF MONEY to go to court. Nobody can go to court who doesn't have hundreds of thousands of dollars to spend. If everyone on this forum gave us just $10, then we'd be in good financial shape. Unfortunately, that isn't going to happen, because a lot of folks would rather complain than donate or just figure that someone else is going to do it so they don't have to. Well, you (meaning all who read this) are "someone else" to everyone on this forum. So PLEASE, send us as much as you can because there's nobody else but Knife Rights willing to take on this fight. I couldn't agree more. I was at kniferights.org yesterday. I said on another thread that everybody on this forum should go there. I should add that everybody should donate too.

This won't go away until a court case shoots it down, and that will only happen with somebody who has plenty of $ to fight it.
 
Guys, would carrying something like a Case Stockman be cause for concern in New York State? I'm going from Toronto to Buffalo for a couple days next week. Will leave my EDCs (currently the Spyderco Delica 4) at home, but still want to carry something if I can. Just doesn't feel right without one, and I'm sure you guys know the feeling!
 
The funny thing is that technically the opening of a knife via a flicking motion is usually a deliberate manipulation of inertia, NOT centrifugal force. Very few knives out there would open up if they were spun rapidly in a continuous circular manner. It's typically that slight snap back that opens the knife because you're withdrawing the handle away from the blade, which continues to move along its previous path due to inertia. That's my take on it at least. :p

Man, I just rec'd an order from them not 6 weeks ago. A coworker recently tried to put in an order and was told NO MORE to NY. Am I going to have to switch to a smaller sheath knife for EDC? This may be the final straw. I'll miss the Adirondacks, but at some point you have to jump from a sinking ship, no matter how pretty some of her parts are.


Aside from writing a letter to the NY DA's office and joining "Knife Rights" is there anyone else that can be contacted about this?

Really? News to me! I happen to have a valid Super Sportsman license. Time to surf through some knife websites! :thumbup:
