Vital Georgia Knife Law Preemption Bill Signed

With encouragement from your phone calls, emails and letters, Georgia Governor Nathan Deal has signed the single most important bill for knife owners and the knife industry to pass this year. With his signature, Knife Rights' drafted SB432 establishes knife law preemption in Georgia, effectively repealing draconian restrictions on knife ownership, sales and manufacturing in cities like Atlanta, home of BLADE Show, the world's largest knife show.

For years the BLADE Show has literally been operating on the "knife's edge"of the law because even though it takes place in Cobb County, where there are very few restrictions on knives, right across the street in the city of Atlanta, where many BLADE Show attendees go to eat, sleep and recreate, there are onerous laws against knives and knife owners.

These local ordinances banned the possession of all sorts of knives readily available and often carried at the BLADE Show including a prohibition against carry of any automatic or any knife with a blade longer than three-inches "readily available for use." An attendee or exhibitor could easily have run afoul of these ordinances and faced fines and jail time. The potential existed to create terrible publicity that could have jeopardized the knife world's most important annual show! With the signing of Knife Rights drafted Knife Law Preemption bill, those threats are now eliminated.

Our thanks to the members and supporters of Knife Rights who made their support known to the legislature and governor and to the bill sponsors, Georgia Senator Bill Heath and Georgia Representative David Knight. Also, a special thank you to Governor Nathan Deal for signing this important legislation.

Having said all that, one word of caution! Please note that this new Knife Preemption Law does not go into effect until July 1, 2012, so BLADE Show attendees should remain cautious this year as the old laws remain in effect until July 1st.

A law of this importance doesn't just pass itself. Knife Rights' Director of Legislative Affairs, Todd Rathner, worked very hard from well before this year's legislative session started in order to pass this bill and get it signed. In the end, he had to spend an entire week in Atlanta in order to shepherd this bill through the final days of the legislature. Congrats and very good to hear! What is the remaining state law now on carry ( or any other ban?)? The remaining issue at the show is often over looked, but should not be. The FEDERAL law banning interstate commerce is still being broken by those crossing state lines with automatic knives as merchandise. It is great to see the exposure to breaking the satae law has been eliminated for future shows, but I don't see any legal way to bring "switchblades" accross state lines for the purpose of selling them at the show. Even for sale to indivual LEOs, the law does not allow this....

Definitely something that needs to be addressed in the future. We must secure the states first before pursuing federal statutes.

To carry a knife with a blade of greater then 5 inches (open or concealed) you have to have a GWCL. (Georgia Weapons Carry License) This includes any style, any type.
5 inches or less is left up to the local jurisdiction you happen to be in. Again, any style/type.

A BILL TO BE ENTITLED
AN ACT
1 To amend Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia
2 Annotated, relating to carrying and possession of firearms, so as to define certain terms; to
3 provide that a county, municipality, or consolidated government shall not enact any
4 ordinance which is more restrictive of the sale or possession of a knife than general law
5 except in courthouses or government buildings; to repeal conflicting laws; and for other
6 purposes.
7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
8 SECTION 1.
9 Part 3 of Article 4 of Chapter 11 of Title 16 of the Official Code of Georgia Annotated,
10 relating to carrying and possession of firearms, is amended by adding a new Code section to
11 read as follows:
12 "16-11-136.
13 (a) As used in this Code section, the term:
14 (1) 'Courthouse' shall have the same meaning as set forth in Code Section 16-11-127.
15 (2) 'Government building' shall have the same meaning as set forth in Code Section
16 16-11-127.
17 (3) 'Knife' means any cutting instrument with a blade and shall include, without
18 limitation, a knife as such term is defined in Code Section 16-11-125.1.
19 (b) Except for restrictions in courthouses and government buildings, no county,
20 municipality, or consolidated government shall, by rule or ordinance, constrain the
21 possession, manufacture, sale, or transfer of a knife more restrictively than the provisions
22 of this part."
23 SECTION 2.
24 All laws and parts of laws in conflict with this Act are repealed.


After July 1st, you will still be required to have a valid GWCL for any knife over 5 inches. This also includes any person with a valid CCL from
any State that reciprocates with GA.
Anything 5 inches or under will be good to go, State wide. :thumbup:
I have my GWCL so I can carry what I damn well please. :D

I also agree that the federal part needs to be dealt with, ASAP.


EDIT: I am not a lawyer so do your own homework before carrying a knife in GA.

Local statutes in Miami-Dade County, apparently designed to deter certain local elements, also affect the law-abiding CWL bearers, perhaps because they do not want to discriminate. So everyone is treated like a criminal.
 
Now to use that as a model to pass similar legislation in Florida, where legislators "forgot" to include knives in the CWL preemption law which now applies only to guns. Local statutes in Miami-Dade County, apparently designed to deter certain local elements, also affect the law-abiding CWL bearers, perhaps because they do not want to discriminate. So everyone is treated like a criminal.

We had a bill in FLA this year, but it was filed too late to really get any traction. We are going to try again next session we need a primary sponsor dedicated to getting it done. Each FLA house member has only a few bills a year they can run so we need to get a legislator involved early. FLA is a priority for us for many reason not the least of which is that my parents live to here so I spend a lot of time there!! ;-)

Glad to here this passed. I got over 20 friends to email for this. I have my GWCL so it did not affect me. But everyone should have the Right to carry a pocket knife. Can't wait for Blade Show. It will be my first.
