I had a transaction in which I sent a forum member a money order in exchange for some knives.
It seems this fellow shipped three knives in an envelope. Not a heavy envelope but a pretty flimsy one.He sent it certified and when I went to thePost Office to retrieve my knives ,the clerk handed me the envelope and there was nothing in it.I proceeded to not sign for it.
When I contacted the member he said he would check it out.
I have since asked for my money back, because the knives are history. He has refused.
What do you think?

I would talk to the moderator of the forum like darrel ralph the guy should have insured them you should in no way be out it should be on his shoulders

All that is not Given Is Lost

The fact that he packed the items poorly should not mean that you should have to pay for the items. He should immediately refund your money. If he does not, you should let all forumites know his name.

There is a similar thread going on now where Ryan Meyering had a very similar situation with Bob Miller of Holly Knives.

The responses in that thread would indicate that it's the seller's responsibile for all items until they buyer receives them in the condition stated.

I've done a lot of business with a lot of members here and on Ebay.I've had to bite the bullet a couple of times and had to send another Money order that was lost and to replace a knife that was lost.On both occasions I reimbursed the person who I was dealing with FIRST and then dealt with the Post Office.

It's his problem, Nifrand, not yours. Contact the guy again and try to reason with him. If that doesn't work, contact a moderator or let Mike know.

Good luck!

You could put nacho cheese sauce on it...

If you mailed a payment for something that you did not receive, and the payment was cashiered by the seller, then you have a case of mail fraud. Contact your local post office.

Be careful. One of the issues that comes up on all of these types of transactions is where the actual title, and risk of loss, for the materials transfers. Is it when he ships to you, or when you recieve it. Yes, he shipped it uninsured, and in a flimsy package (two separate issues really), but did you ask him to do otherwise, or did he agree to do otherwise.

Next time clearly state your preferances on shipping, insurance, risk of loss, and packaging. These variables can and are negotiable on most transactions.

Having said that; I would expect that unless buyer or seller stated otherwise, that the buyer would have a reasonable expectation of receiving the goods in the expected condition. He should refund your money and file a claim with the shipping company.

It is the sellers responsibility to insure and make sure you receive the knife PERIOD!
Or give you your money back.
THIS SHOULD NOT BE A QUESTION!

It might sound strange but I woul have to question as to why he would use an envelope when post office gives the nice thick priority boxes away for free. The cost would about the same by weight,Couldn't be more than a dollars difference. He owes you some money!!!

Thanks guys for your responses.Next step is "The Good,Bad and Ugly" and the the Postal Inspector.
