new and unused?

was looking on the auction site and this schrade was being offered as New and Unused. it had been rehandled and had had file work done on it. my question is, is it still new and Unused after this has been done to it?
and on the funny section some person was offering a three pin LB 7 for auction and describing it as mid 70's. i just had to ask him the question what did he consider mid?
