New Idea, Need some help

This weekend I got a bright idea. No really, I think it might actually be a good idea.

Does anyone here now about seeking a patent? Trademark? Which one is the better way to go? What's the difference anyway?

I also thought about working with a knifemaker to produce the idea. I would just want a bit of the credit for the idea, assuming anyone cares. If I opt for that does anyone have experience with working with makers? Would be best for a tactical folder, but almost any knife would work.

Do to my current location/career I think the working with a maker may be the best way to go.

If the whole thing is a wash I'll post my bright idea here for the examination/use by all. If no one benifits it's not such a good idea.

Look up a trademark/patent lawyer in your area. Mine had cost me $700 for everything( worldwide coverage,copy of logo and name, and paper work to be filed). DO A SEARCH . Search is they will look up your idea to see if anybody else has it. It will save a lot of pain later. I KNOW!!!

There was a good thread about patents and trademarks and the applications for such on here a few months back. Do a search on 'trademark' and 'patent' on these forums and you should find it.

Basically you patent an idea or new piece of technology. You trademark a brand or logo. One is to ensure no-one profits from your idea without your benefit and the other is to make sure no-one trades under your name or logo.

In Oz we have an excellent government funded small business resource cennter that is like a one stop shop for that sort of information and it would be my first port of call if I where you. I'm sure there would be something similiar stateside. Over here it is called the small business dvelopment coporation.

If you plan on using a lawyer for a patent plan on spending at least 3,000.00 for a patent. Here is a web-site that may be of use to you, it is the U.S. patent office site: www.uspto.gov. Good luck,

I'll have to think about it some more. Hell, may just give away my little idea rather than pay that amount of cash.

I see why people sometimes just Trademark things. Especially, since our government does so little when other countries blatantly steal our ideas/technology.
 
Yes, For my trademark it covered everything. This was 11yrs ago.

Before you waste time and money, email your idea to me and I'll let you know it it's any good.;)
 
My patent atty: cost me 5000.00 to draw up a scaled version and write the dissertation about the project and it's intended use.

After 7 months, the patent office wanted another amount of money to grant the patent for three different time frames to expiration of same. The funds required were proportional to the time frame picked before the patent would have run out.

Think I may work up a few. Maybe get a custom maker to work with me.

Do the trademark thing maybe ($700 more?!?!) and let that be it.

I may just post it here in the end and let people do as they may. I think it's a solid idea but not sure it would make a ton. Also, like many patents I think it could be gone around or just done overseas like so many other things.
