Hi everyone. I'm new to the forum and must say it's a great place for info on anything knife related. My question pertains to the auto knife laws on NC. Is it legal for non LE/Military to own and carry as long as its not concealed ? I have read and been told conflicting things and thought I would post here to get more facts.

Thanks

SUBCHAPTER IX. OFFENSES AGAINST THE PUBLIC PEACE.
Article 35.
Offenses Against the Public Peace.
"§ 14‑269. Carrying concealed weapons.

(a) It shall be unlawful for any person willfully and intentionally to carry concealed about his person any bowie knife, dirk, dagger, slung shot, loaded cane, metallic knuckles, razor, shurikin, stun gun, or other deadly weapon of like kind, except when the person is on the person's own premises.
...
(d) This section does not apply to an ordinary pocket knife carried in a closed position. As used in this section, "ordinary pocket knife" means a small knife, designed for carrying in a pocket or purse, that has its cutting edge and point entirely enclosed by its handle, and that may not be opened by a throwing, explosive, or spring action."

Autos are probably covered (and prohibited) by the "other deadly weapon of like kind" phrase in section a.
And 14-629 definitely applies to autos, via the "spring action" phrase in section d.

It even appears that assisted openers (as in Kershaw Speed Safe) might be
disallowed by the 'spring action' phrase in d.

Note that "other deadly weapon of like kind" and "spring action" are vague phrases, and therefore open to interpretation by police, judges, etc.

I found no reference to 'open carry', but that does NOT mean it's OK.

It is illegal to carry an auto open or concealed in north carolina.

Thanks for the info guys. I had looked over the general statutes prior to posting, but wanted to make sure I was clear on the laws. I don't understand why the state will grant me a concealed weapon permit but not allow me to to carry an auto knife. These laws will not stop a criminal from having one just like the present gun laws won't stop the bad guy from carrying it as weapon. These laws only restrict the law abiding folks and it just not logical in my in my opinion.

Ok , I'm done venting now !!!!!!!

I agree 100% with that,The laws it seems was not designed to assist the law abiding citizen the right to defend him/or herself by any means. I think that laws need to be changed because the current ones stink.

Where does it say that you cannot open carry an auto? I also have not found anything permitting or prohibitting open carry of an automatic knife.
