New way to get life in prison in OK

Cops called to domestic dispute, hauled the guy away yelling screaming, and spitting.

Goes to Court today for sentencing.

Guy gets a year for domestic violence.

Then they give him a life sentence for spitting on cop. Seems attempting to tranfer bodily fluids which may include deadly organisms is next thing to murder. Whether you have AIDS or not.

S'pose the moral here is ...

Anyone come up with one?
 
Whoa, I thought kissing didn't transmit AIDS and that it is a vulnerable virus that can only be transmitted in the absence of a condom or by blood-to-blood. Could we have been misled? Is there any chance the man was handled by sweaty cops and could countersue for bodily fluid transfer?

It's a crazy world, but I guess that has been said for generations. The thing that bothers me, the government, police, and coporate "America" is really dumping on the "little" people.

My sister lives in Edmond and I know there is a different mindset. I don't wish to offend but there are to many religious types who influence politics. :(

Doesn't offend me because it's true. It's also true that minorities get stronger and longer sentences than the predominant people usually, this case is an exception and IMO is way to
harsh!!!!:( :grumpy:
 
I agree, I been there. The blacks and Hispanics were messed with big time. I sat quiet and mind my own bussiness while the skinny, immature, correctional officers, white pukes, phucked with them.:mad:
 
He broke his wife's arm and ribs, that's "misdemeanor assault."
He spits on a police officer, that's "two felony counts of assault and battery on a police officer and placing bodily fluids on a government employee."

I think our police officers need our support and protection, but I am against ANY law that gives them privileges denied your average citizen. E.g., ability to purchase automatic weapons, larger penalties for assaulting them, etc.
If everyone was equal under the law, these laws would not exist.

I have to disagree with that stripey. A uniformed officer should be treated as the authority in our society. Cussing or threatening one another is a regular occurance, but to allow that to occur to officers is unacceptable. Officers are there to enforce our laws. They need to be given an automatic respect. If they are treated the same as everyone else, why should we even listen to them? If I get into a fight with Joe Shmoe, it is a fight. If I am questioned by Officer John, and get into a fight with him it is entirely different.

On the original post, I do think that 'life' for spitting on someone may be excessive, but nowadays, it is not a passive matter. Anyone who handles, or touches bodily fluid, blood, and saliva need to be very cautious of the potential consequences.

Officers should also follow the laws they are supposed to enforce.

1) State Patrol Officer goes home and beats his wife so bad she is crippled and he is still on the force, although in another Nebraska town.

2) 4 local police officers are out driving around the countryside drinking. There is a dispute between the driver and another so they head back to town. They get on the freeway(I80)and hit speeds in excess of 100MPH, the SUV rolls killing the 2 officers in the back and injuring the passenger in front. The driver gets 90 days and 4 years probation and is appealing that. The drivers blood alcohol test was double the legal rate.

3) A huge drug bust goes down in North Platte after a fereral sting. Included on the list of those involved are police officers,lawyers, a judge, several business owners and over 350 others. That's just the first list. You can go up to the court house and ask for a copy if you would like to.

I'll leave the judgement up to you.
 
Let me amend my rash statement to say that a police officer should of course be treated with the respect of his or her office. That is not the point.
Our Constitution grants us equal protection under the law. It is rather disturbing that you get 2 years for breaking your wife's arm, but life in prison for spitting at a police officer.
This is just giving the appeals court a chance to let this scumbag go free on "cruel & unusual punishment," IMO.
 
From the article, it sounds like the guy was a punk, and his actions went a little beyond spitting. IMHO, a felony conviction for *just* spitting on someone is a little harsh. That would be different if the person knows they have a communicable disease, like HIV or hepatitis, and is trying to spread it.

While police should not be above the law, I think that they deserve an extra measure of respect. At the very least, they do encounter people that want to do them bodily harm, and have the tools and training to respond with deadly force. So for my personal safety, cops aren't trifled with. That's not to say that police should be automatically obeyed under all circumstances, but I'd like to think that most officers play by the rules and use their authority properly.
 
AIDS cannot be transimitted through spit unless there is blood in it AND that in the spit somehow does not get exposed to oxygen, AND the spit with the blood flies into a deep cut with enough quantity that your own white blod cells cant kill it in time b4 the virus gets lodgeed into your T-cells

in other ords THERE IS NO WAY OF GETTING AIDS THROUGH SPIT OR SALIVA EVEN KISSING.

its oxyegen thats kills it.... Oxygen is to a virus is like holy water to a demon... not many viruses//bacteria are immune to oxygen. oxygen rips them up in a split second.

on another note... seems kinda stupid that he got life in jail for spitting on a cop... i guess spitting on a cop can be considered assault.
 
I agree that HIV would be difficult, if not impossible, to transmit by spitting. But I think that if someone with diagnosed HIV or another illness tries to spread it to other people to intentionally harm them, they should be held accountable. That said, the penalty for spitting is probably the result of ill-informed paranoia.
