my friend talked to a local LEO about the blade length of a knife in upstate new york and he said the blade could be no bigger then the width of the knife carrier's palm. Can someone verify if this is a valid statement because i've looked and i can't find anything about a limitation on blade length in upstate NY. The only thing i discovered in my research that in NYC the blade can't be bigger then 4 inches, nothing about upstate ny
 
New York State _ penal law section 265 that is all there is state wide the rest is all stories. The Sullivan law was dropped when the present Penal LAw was enacted. ( about 40 years ago) NYC city has the 4 " law in the Admin Code. I don't know of any other NY counties that have a lenght restriction, so there may be some. There is NONE in the state law.....

City of Yonkers (in Westchester County) also has its own restrictions; don't know exactly what they are.
 
There is no illegal length in Upstate NY. Although, if you get caught carrying a "rambo" style knife in your waistband, that is a totally different scenario.
 
So I guess the lucky guy who just got an 18inch 1/2inch stock 1095 bowie from me better have the ultimate in a concealed carry rig. rotflmao.
 
It is my understanding that NY doesn't have any concealed carry statutes, for either guns or knives, although carrying concealed may imply "intent to use unlawfully."

Furthermore, even though there is no length restriction on knives (daggers and autos are restricted), there is a vaque restriction on "dangerous knives" carried "with unlawful intent." Thus, a Bowie or large tanto carried concealed could be prosecuted. A 5" single-edged fixed blade would be less likely to be prosecuted -- especially if worn openly.
 
Sorry if this is slightly off-topic, but I was just told by two people (who live in NYC) that I cannot carry a multi-tool on my belt or in my bag and hope to get away with it on the subways.

I was told that if I were picked for the "random" bag search, and they find the multitool (vic Spirit or Leatherman surge (both < 4" blade)), they will confiscate it.

Is this true??? I live in NJ, and I will have to start taking the subway this fall, and I will be very sad if I cannot EDC my multi-tools...
 
As long as the blade in under 4" it is legal, but the Admin Code states no knife is allowed to be displyed ( as in belt pouch)
 
I was planning on getting a Cold Steel Recon 1 (folding knife with a 4" blade). Should I be reconsidering? If the blade was a little shorter, I know I'd go for it.

I don't think this is true - if what you are carrying isn't illegal, they have no legal right to confiscate it.

Personally, I wouldn't worry about it. I carry a leatherman in my bag and a small folder in my pocket every day and I take the subway every day. And I've been picked for the "random" bag search. It was a very cursory search - unzip the bag, cop peers in, nothing interesting to see, I'm on my way. The cops aren't there to hassle law-abiding citizens carrying knives - they are there to deter potential terrorists. As long as you don't give off a wierd vibe to them, they're probably not going to hassle you.

Let me know if you learn different, but I think you'll be just fine carrying a multi-tool. I'd recommend carrying it in your bag, not on your belt - discretion is always a good idea. On the other hand, I know of someone who works in the city and wears his multitool on his belt. It's your legal right - don't be afraid to exercise it.
