Title pretty much says it all. I know there was suppose to be a hearing on election day. Anyone know what happened?

Judge Fahey denied the Motion for Summary Judgment in a one sentence order that, in effect, said that he did not agree with IEI's position that California’s law banning the trading of ivory is unconstitutional on its face. The judge provided no elaboration or detail on how he reached his conclusion and he did not comment on any of the specifics of the claims. The judge further ordered the Deputy Attorney General to prepare Findings of Fact and Conclusions of Law on the case by December 23, 2016.

IEI will have an opportunity to question her Findings and Conclusions and are likely to do so. Once the judge has considered what the State provides and the objections IEI raises, he will issue his final judgment.

IEI will decide exactly if and how to proceed once they see the Findings of Fact and Conclusions of Law. The 60-day clock for launching an appeal starts running from the date the Judgement is signed and filed. That will give IEI to the end of February to file a petition with the California Court of Appeals.

Lawsuits are a marathon, not a sprint. The marathon continues.
