Non paying members are selling on the forum.....

No. The mods will be along to lock or delete threads when they find them. I'm guessing it probably helps them when people report the threads to them.
 
The people I saw were paying members they just didn't upgrade their status. Easy way to check is click their name and see if PM is available...
 
If you're speaking about non gold posting in the for-sale sections it's because they haven't updated their user group yet. They would not even be able to post in that section had they not have a paid membership currently.
 
If someone is able to start a thread in any of the "For Sale" forums, they have a Gold or higher membership but haven't updated their user group settings.

Click the small black triange under any offensive posts. Tis will take you to a screen where you can explain why mod intervention is needed.

Looks simple enough to me. It takes some initiative though, looking through the profile settings which is part of being a member of any forums.
 
If I see a non paying member mention it in a trade thread, even hint at it, should I report those?
