Oh yeah, who owns the forum here on BF? Definition:

An employee is a person who works in the service of another person under an express or implied contract of hire, under which the employer has the right to control the details of work performance (Black's Law Dictionary).

An employee is hired for a specific job or to provide labor and who works in the service of someone else (the employer). The IRS classifies a worker as an employee as follows:

In general, anyone who performs services for an organization is an employee if the organization can control what will be done and how it will be done. :p

The definition(s) of a CONTRACT as it applies here is:

a : a binding agreement between two or more persons or parties; especially : one legally enforceable
b : a business arrangement for the supply of goods or services at a fixed price <make parts on contract>


I have no legally binding contract of any type between myself & the Bossman and/or myself & Spark AND... There is no payment for my "services" under a "business arrangement". I receive no goods or even a discount on said goods for what I do here as a Moderator. At any time and without notice, Jerry or Kevin can tell me to go pound sand, remove the red from my name (remove me from Moderator status) and there's not a single thing I can do about it...and vice versa (without the go pound sand part, LOL :)).

No, I volunteer my time & services. The definition of a volunteer as it applies to me here is:

A person who voluntarily undertakes or expresses a willingness to undertake a service: as one who renders a service or takes part in a transaction while having no legal concern or interest.

Big difference from being an employee, wouldn't you say? :D

Now...and this is just a hypothetical example and NOT any type of threat (I want to be very clear on this! :))...I cannot be controlled under the legal definition of "control". There is nothing stopping me from banning you for no reason. (AGAIN, hypothetically speaking only!). Granted, I would be willing to bet that this would be my last act as a Mod, and you would be reinstated without question, and I'd most likely be permabanned, myself! ...But there is no legal control. I'd never abuse my privileges in such a way, and I've agreed to moderate as fairly as I can, and I do agree to how Jerry & Kevin wish to have the forum moderated, but control is not there. I cannot be sued for such misuse of action. They cannot dock my wages for I'm not being paid. I cannot be arrested. All aside, I've been told how the forum should be moderated, and have been given many great suggestions on how to accomplish this by other wiser & more experienced Mods here. Other than that, I'm pretty much left to my own devices. :)

If he was an employee, he wouldn't be posting guesses here, for obvious reasons (to any sentient): Why would Busse Inc. or Corp. let employees spoil their own teasers?
So, he's not an employee, he moderates a message board. He knows no more than the rest of us. Is that really so hard to comprehend?
 
As requested, and rightly so, these off topic posts were cluttering up Jerry's BKGAB contest thread, so they've been moved here. This isn't serious...just a li'l good natured arguing, at least on my part, but these posts did really go way off topic. :)

I don't know. . . Doink's shirt says team busse combat, he has an exhibitor badge on and he's holding one of the folders. Smells like he's the employee to me. Brilliant distraction my friend. Well played.
