Tenants called last week. Said they had gotten a high water bill, but thanks for the rat extermination.

Yeah, we put out a lot of rat bait. Told the tenants that they need to be more clean and take out their garbage more than once a week.

Went over to check for water leaks. Found two feet of water in the cement-enlcosed basement. It seems that the rat poison made the rats very thirsty, so they gnawed through the pvc plumbing and had a nice drinking fountain.

Unfortunately the furnace / HVAC is in the basement. The water got into the blower motor and the circuit board. We are installing a new furnace / HVAC today. The water heater pilot was under water. Did they not bathe for a few weeks?

Do I bill the rats?

Rented this house ot a really neat old woman. Not alltogether there. Rent was $750 and we kept getting checks for $700.50. Had to go over there a few times, make out the check and have her sign it.

Last week we did not receive the rent. Sent my maintenance man over to see what had happened. After six years, she decided to move. But her son was staying there. No rent.

A LOT of stop-and-go traffic. In the 30 minutes three cars stopped by, the drivers went around to the back of the houes, where my guy, Mike was not permitted to go. They stayed a few minutes and left.

Mike was getting very uncomfortable. They were beginning to get threatening. He called me and asked what he should do. I told him to clear out and I would call the police. He went out to the street and waited.

The police told me that they might "talk" with the people. I said, "How about criminal tresspass?"

They said that the only way they would enter the property, or even walk up to the front door was if Mike went with them.

I called MIke. He said that he was not going up to the houes even with the police. They had threatened him and he had just seen a new "crew" drive up to the house and two of them were carrying military rifles, looked like AK-47s. Mike is "street" and not given to exageration.

I called back and explained the situation to the Zone Shift Commander. He repeated that they would not go on the poperty unless Mike or I walked up to the door with them. That I would not do, nor would I ask Mike.

I talked with the beat officer and she told me that the neighbors had many complaints about traffic and noise, but no-one would "stand with her" and approach the house.

I have run out of options. My only choice is to file a Dispossessary Warrant and go through the Civil Division of Magistrate's Court. This could take a month. I have started this process.

I know that a house can be seized if drug activity is present. Sure looks like it to me, so I asked the Shift Commander about this possibility. He said that if I was trying to evict them, the police could not seize my property.

I am very frustrated and don't know what to do. It looks like my house is a drug infested bane on the neighborhood.

Anyone have any ideas?
 
Get in touch with a local REI Club. You might find others with helpful ideas.
Or a local or state landlord's association. Plenty of good, inexpensive info available from people with similar experience.

Look for them on the net.

Keep the faith - this stuff does and can get sorted out.

File a claim with your insurance company for the water damage.

Evict the deadbeat tenants.

Those of us that have been landlords know you get a bad tenant now and then. Deal with it, make repairs and move on to the next tenant.

I would not take the word of a cop about any potential property seizure due to a possible drug bust. Speak to an attorney.

There, I just solved it all.
 
I have a tiny idea of what that must be like.This guy I know is a landlord with a few houses. Every time I talk to him it's a new story about how the tenants don't want to pay rent, are breaking things out of carelessness or malice. And so on for the last 6 years now. It's rare for us to sit down for a chat without the phone ringing. He's in court monthly trying to get rid of a bad tenant.

Once, at 2:15 AM I watched him take a call from one of the tenants asking why they couldn't open their ornamental bathroom window. He'd just switched his phone on for a few seconds to check his messages. There were about a dozen messages from this one idiot wondering why they couldn't open the window up by the ceiling, the one with no handle on it.

I think speaking to an attorney is a great idea; assumed you had one if you are a landlord.
 
Deep breaths Bill . That talking to the drug squad might be a good idea . It seems that may take some time as well . If they do get involved they might not have a gentle approach as far as your property is concerned . Have you considered talking to a local politician ? If you are in good with the guy he might lite a fire under someones butt for you . That might become more high profile than you want .
 
Rifon2 – We have probably the largest and most active REI in the country. Georgia Real Estate Investors Association. GaREIA I have spoken to this group a few times. Am a member of the Old Timers’ Club. I have been in real estate for 41 years.

Steely_Gunz / Jake – that idea has crossed my mind on several occasions! Like about once a week! Let’s see 41 times once a week = 52*41=2132, but nah. This is a little bit heavier, just a little bit heavier than my usual once-a-week surprise. Most are on the order of the flooded basement.

Steve – would have done that once, but insurance rates on rental properties are high and the underwriters are skittish. Claims make them nervous. I have a $500 deductible an can fix these problems for less than that (see end comments).

I did file an eviction or Dispossessory Warrant. I file about five a year. No big deal, but it is almost like tenants have a seminar somewhere on how to get around this --- or at least delay the inevitable. I always win, but a smart tenant can put this off at least a month while they live there free.

Often I bite the bullet and just turn this over to a guy who files and goes to Court for me, cheap. But I felt a duty to the neighborhood to try to rid them of this menace. We have a lot of property and we can’t keep tabs on what every tenant is doing. However from this mess has emerged a new procedure. I am making sure that neighbors around every one of our properties have our name and phone number so they can call and report a bad tenant.

I did talk to an attorney and he said the cop was right. He also suggested that I send a certified letter to the Zone Shift Commander informing them of my feelings in this matter and request “vigilance” of the local beat officer.

Rifon2 – have several good people who advise me. An attorney is at the top of the list. Always pick someone intimately involved in real estate. I have two years in law school. Never felt like becoming a member of the Bar, except where they serve Heinekens!

Kevin – You got it! Good luck in your real estate acquisitions! You have an innate sense about handling problems.


ENDGAME and answers!

Rattas and flooded basement. Rent pump from Home Depot. $35. buy scratch and dent furnace from supplier who has a bad forklift driver. I can get one that is only useable for parts for about $100. may have a forklift blade through it, but most of it is ok. Cost about half of the needed parts would run. Mike makes $15 / hour. Switched out bad parts in less than a day. Done for less than $250, parts and labor. Insurance deductible is $500. I call this a “win.”

We will watch the water more carefully when we have a rat infestation. Did not have this problem before these tenants moved in. Had to explain good housekeeping to them.

I will also help them get the high water bill reduced.

Drug dealing rats – Had to think about this one a while, but had a good answer from my wife, Anne.

Anne was a director of the Georgia State Senate Public Information Department for about 13 ½ years. We know a few people. A Senator called a local representative and the rep called a councilman and the councilman called the Zone Shift Commander. Can’t go into details, but yesterday afternoon a few of our Atlanta’s Finest entered the property and while there made an identity check. Two arrests. Not for drug violations, though there was evidence, but for parole violations and an outstanding warrant.

We boarded up the empty house last night, well, I didn’t. Mike and his crew did. Neighbors came out and thanked him The police are watching the property to be sure that no one decides to come back. Now it would be an easy case of criminal trespass.

BTW the Zone Shift Commander is calling me “sir.” "Call me anytime, sir, and we'll be very responsive."

It is not what you know, but who you know. Actually it is more “Who knows you” and remembers you when you call. I’ll buy a few drinks and dinners for this, but it always helps to get involved in local politics.

Next week it will be something entirely different, but we will deal with it.We have a good team and resources.

Thanks for being there for the vent. Though I have been doing this a long time, it still gets irritating. But we deal with it. I guess that I should not be disappointed when tenants do not keep their agreements. I keep mine.

I try to see real estate as "pure entertainment." There is a new story every day! Having Mike and few other people as buffers really helps.

Met with surgeon today. He said my progess was "outstanding!" I am off the narcotics. Just taking Tylenol and not too often. Now have a range of motion of almost 115 degrees. Only 135 in my other knee, so I am close. Will get there in the next few months. He says I am "over the hump" and the knee will get better slowly on its own.

Cutting back on the super workouts from three to one a day. Driving a car. Gonna try the motorcycle this weekend.

It is working. Still painful, but better every day. Up to walking about two miles now. Come back tired and a bit swollen, but it is ok.

Still too soon to make vacation plans, but in about a month, will be planning some trips. China is a possibility!.

I had absolute angels for tenants because I was overly picky. I didn't even have to vacuum. And I had a horrible amount of vacancy for the same reason:

"Can I bring my cat for 3 months?"
"no"
"It's a really good cat"
"no"
"OK, I promise I won't bring it."
"Yeah, right"

(I don't hate cats, per se, but pets can do an astonishing amount of damage. Especially on a short term rental.)

I know a guy who will not rent to either lawyers or cops because they know how to use the system to jerk him around.
