Open Carry in Florida

Is a knife carried clipped to the pocket with the clip and butt(of the knife:))showing considered to be concealed or open carry? Assume that one's shirt is tucked in and the clip and knife are in plain sight.

I've searched this forum and haven't been able to find an answer to this specific question.

I've had State Probation and Parole Officers here in TN at worksites spot one on me many a time like that. Of course I'm not on probation or parole and they let me pass and do my work. If they can spot it in plain view, I would think it would be open carry.
 
If it can be seen in plain view it is considered open carry,exposed butt and clip or in sheath.:D
 
sorry to bring this back from the dead. i just saw it. i don't have the statute book in front of me, i'll be able to check tomorrow evening. however, i'm pretty certain that if the majority of the blade and handle were in the pocket and only the clip and the very butt of the knife were exposed, it would EASILY be considered concealed.

knowing what i do about FL laws, i truly believe the only way to prevent a folder w/a clip from being "concealed" is to clip it to your belt (shirt tucked in) and have the entire body of the knife exposed.

i am not a lawyer, but have been a FL LEO for many moons and have had several conversation w/alot of different LEO's on how they not ony interpret the law, but explain the violation on the arrest affidavit. don't misunderstand - nothing shady or dishonest, but it is easy for them to explain why they considered it this or that and difficult to explain why you disagree unless you get arrested as often as they make arrests.

a similiar sitch would be a FB with your shirt over the handle, but the entire sheathed blade visible. YES it would be obvious you were carrying a knife, but YES you'd most likely be arrested for having it concealed.

I would ASSume that it works the same as a handgun. If it 'prints', IOW, the outline or general form is visible, it is considered open.

FSS 790.001(3)(a) defines a "concealed weapon" as follows:

any dirk, metallic knuckles, slungshot, billie, tear gas gun, chemical weapon or device, or other deadly weapon carried on or about a person in such a manner as to coneal the wepon from the ordinary sight of another person.

now, this is from an old statute book, the new one is around here somewhere, but i'm almost certain they have not changed the definition. i believe it's the last 5 words that'd make it "concealed". i also think those same words would mean that printing (handgun) would not mean you are open carrying.
