PA Knife laws...?

Hello everyone
I live Just outside of philadelphia, PA, and I have few questions. I have read the PA knife laws (the ones that define what an "offensive weapon" is), but there is nothing that I could find about street legality. should I just assume that the legal size is under 5"? or under 3"?
im just wondering, because I plan on getting a Microtech SOCOM Elite, and the blade is just over 4"...

If you are planning on getting the SOCOM Elite auto...it is illegal to carry anywhere in Pa. Philly has different laws and will get you for carrying pretty much any knife. I never have a knife clipped to my pocket when I'm in Philly.

There aren't any Pa. state laws regarding blade size that I know of. You're good if you avoid autos.

EDIT: If you are getting the manual SOCOM Elite you're fine.....

and okay, After an hour of snooping around google, I came to the same conclusion.
thank you very much. and to clarify, Spring assist are legal in PA, right? because, even though the law regarding the matter says makes the matter hard to decipher, it seens SA knives are legal. after all, they are sold in every sporting goods store in the state.

You are correct...spring assisted or assisted openers etc are legal in Pa.

My CCW gun permit is legal in philly.

I was unable to find anything on knives per se in the Philly Code, except that switchblades are illegal (again) and you cannot sell box cutters to people under 18 (§ 10-829). Apparently, it is also illegal to sell or possess bows and arrows, air guns, spring-powered guns, and...squirt guns? (§ 10-810) Okay, seriously what the hell?

Are you sure? I live in md so no CCW for me. But my gf was going to go to grad school and live in philly, so I was going to move there with her. I did some research because of this, and I THOUGHT that I read that you could NOT carry in philly. Maybe i'm wrong...but I thought you couldn't.

There are loads of pages out there on the internet about knife laws. But so many of them are complete hearsay or conjecture. If you find that source, please let me know if it has a citation to the statute. No statute, no law.

You can carry a gun with a CCW in philly for sure.
The mayor tried to make it illegal and couldnt get away with it.

** § 10-810. Weapons and Dangerous Devices.

(1) Discharging Firearms. 168 No person shall fire or discharge recklessly and without reasonable cause any rifle, gun, pistol, or other firearm.

(2) Water Pistols, Electric Canes, and Miniature Cannon. 169

(a) No one shall sell or offer for sale water pistols, electric canes, miniature cannon, or similar articles. 170

(b) No one shall use water pistols, electric canes, miniature cannon or similar articles in any street or public place.

(3) Spring Guns, Air Guns and Bows and Arrows. 171

(a) No person shall sell, offer for sale at retail, or use, or possess with intent to use, any air gun, spring gun, or any implement not a firearm which forcefully impels a pellet of any kind.

(b) No person shall sell, or offer for sale, at retail, any bow and arrow, to any person under the age of twenty-one (21) years unless the seller first obtains written evidence of parental consent to the proposed purchase by the minor. 172

(4) Switchblade Knives. 173 No person shall sell, offer for sale or carry any knife with a blade which is released by a spring mechanism including knives known as "switchblades".

(5) Incendiary Paper. No person shall manufacture, sell, offer for sale, carry or store any incendiary paper that has been chemically treated to vanish at the touch of a flame, including paper known as "flash paper". 174

(6) Penalties. Whoever violates any provision of this Section or Section 10-821 shall, in addition to other penalties provided, forfeit the weapon, contraband, or dangerous device giving rise to the violation of such Section. 175

(7) Confiscation. Police officers shall seize and deliver into departmental custody any air gun, air pistol, spring gun, switch blade knife, incendiary paper, contraband weapons, accessories and/or ammunition or other implement which shall be used, discharged, possessed, offered for sale or carried in violation of Section 10-810 or Section 10-821. 176


** § 10-820. Cutting Weapons in Public Places. 189
(1) Definition.

Cutting Weapon. Any knife or other cutting instrument which can be used as a weapon that has a cutting edge similar to that of a knife. No tool or instrument commonly or ordinarily used in a trade, profession or calling shall be considered a cutting weapon while actually being used in the active exercise of that trade, profession or calling.

(2) Prohibited Conduct. No person shall use or possess any cutting weapon upon the public streets or upon any public property at any time.

(3) Penalty. The penalty for violation of this Section shall be a fine of not less than three hundred (300) dollars and imprisonment of not less than ninety days.


** § 10-833. Possession of Weapons on School Property. 202
(a) Definitions.

"Weapon." For purposes of this Section the term shall include, but not be limited to, any firearm, shotgun, rifle, knife, cutting instrument, cutting tool, nun-chuck stick, and any other tool, instrument or implement capable of inflicting serious bodily injury.

(b) Prohibited Conduct. No person shall knowingly possess a weapon or knowingly cause a weapon to be present, whether openly or concealed, in the buildings of, within one hundred (100) feet of, or in any conveyance providing transportation to or from any elementary or secondary publicly-funded educational institution, any elementary or secondary private school licensed by the Pennsylvania Department of Education or any elementary or secondary parochial school.

(c) Exceptions. The prohibitions set forth in subsection (b) shall not apply to:

(1) The lawful performance of official duties by any full-time officer, agent or employee of the United States, the Commonwealth or a political subdivision who is authorized by law to engage in or supervise the prevention, detection, investigation or prosecution of any violation of law.

(2) The lawful performance of official duties by a school official.

(d) Penalties. The penalty for violation of this Section shall be a fine of not more than three hundred ($300.00) dollars, or imprisonment of not more than ninety (90) days, or both. The fine may be imposed through the confiscation of the illegally possessed weapon by the City of Philadelphia Police Department, said weapon to be melted down or rendered inoperable thereafter.
 
§ 10-820 appears to the big one in this situation. Wow, that sounds worse that the New York City law.

That basically what I said. There seems to be this idea that all knives are illegal to carry in Philly. No proof of that so far though.

It looks like you missed a good bit of Jaxx's post. Basically any knife...regardless of size can be considered a cutting weapon in Philly.

it is absoutly leagal to carry a blade in philly just know ur rights!! cops dont pother people in philly unless they are up to serious suspicious activity so i wouldnt worry about carrying anything. you prolly could get away with carying the auto but just to be safe keep it legal

this is funny because there are army navy stores in philly that sell knives i think this is an old unenforced law!!! no cop is gonna stop you let alone look at your pocket when u live in a city especially if your not doing anything wrong

It is not "absolutely legal" to carry a blade in Philly!! SEE POST #10. I did not pull this outta my azz, I pulled it out of the official Philadelphia Code & Charter word for word. Also, I live just outside of Philly, and have for most of my life. That is the law within the city limits of Philadelphia, and the most current version of it is what I posted.

...Yes, I suppose that you could carry a knife in Philly and never get caught, but THAT DOESN'T MAKE IT LEGAL! Just sayin'.

There are stores that sell bongs & pipes in Philly too, but that doesn't make these legal for smoking weed out of, does it?

It is one thing to sell knives... It is another to carry them. Also, other than autos (switchblades), I have yet to find any restriction on selling blades other than restrictions about selling knives/boxcutters to minors. That may be because it is legal to carry manual or assisted opening or fixed-blade knives anywhere else in the state, barring possible restrictions in Harrisburg, or Pittsburgh, or other large municipalities classified as 'cities'.

Sorry but you're wrong. Carrying an auto anywhere in Pa. is illegal. Carrying any knife in Philly could easily be viewed as illegal depending on what the circumstances are. Obviously much of this is subjective and depends on what the person carrying the knife was doing and how the LEO viewed the activity. If you get a LEO that feels you're carrying a "cutting weapon" that happens to be a Case Peanut.....guess what....you're going to court to fight the definition of "cutting weapon."

I'm in Philly all the time and always have a knife IN my pocket...not clipped. I think Philly's knife laws are stupid but they are what they are.

It says you cannot sell squirt guns or BB guns. i know they are sold in philly.
