Patent/Trademark Protection?

I just saw a pic of a Peter Marzitelli custom called "Osprey." Delta Z is coming out with a production knife, a Darrell Ralph design I believe, thy call "Osprey." I know there's a lot of design copying in the knife world but I imagined that at least the names would be unique.

Common practice??
 
The knife for Delta Z was designed by Darrel Ralph. Therefore it is licensed by him, methinks...

It's a collaboration between a custom maker and a production company. That is fairly common these days especially.
 
Marz is Canadian so any trademark protection that he had disappeared when it crossed the border unless he shelled out a lot of cash to trademark it in the US as well. Trademarks, patents and copyrights are useless unless you have DEEP pockets to defend them, for the small maker it isn't worth the effort to even register.
