Pen Flares, still legal and where to get if they are?

The title says it all. Are they still legal in the U.S. and where can you get them here in this country?

Man, did you see that 'Statement of Intent and Usage'... Looks more restrictive than for a handgun. Make sure you don't store them at home now... Office ok though. Wonder if that is just for the bear-bangers or all the flares?

Ammo can seems more than adequate storage for these flares to me...
