Is it legal to carry a knife in pennsylvania? Is there anyway that you can get a license to carry knife in PA?

I belive that this is was still stands in effect

Pennsylvania - Pa. C.S.A. 18.908. Prohibited offensive
weapons. (a) Offense defined.--A person commits a
misdemeanor of the first degree if, except as authorized
by law, he makes, repairs, sells, or otherwise deals in,
uses, or possesses any offensive weapon. (b) Exception.--
It is a defense under this section for the defendant to
prove by a preponderance of evidence that he possessed of
dealt with the weapon solely as a curio or in a dramatic
performance, or that he possessed it briefly in
consequence of having found it or taken it from an
aggressor, or under circumstances similarly negativing any
intent or likelihood that the would be used unlawfully.
(c) Definition.--As used in this section "offensive
weapon" means... any... dagger, knife, razor or cutting
instrument, the blade of which is exposed in an automatic
way by switch, push-button, spring mechanism, or
otherwise...
- also see 24 P.S. 13-1317.2. re: students bringing weapons
on to school property.]

Pennsylvania case law:
Where opening knife required lock to be released, and
once lock was released blade could be exposed by flip of
wrist, knife did not have blade which could be "exposed in
an automatic way"... by "otherwise" legislature referred
to knives that were opened by some sort of mechanism which
is not a "switch," "push-button," or "spring" mechanism
but still a mechanism... (1979)

so that means I cant carry a switch, push-button or a spring knife with me? and if I did what would be the consequences?

it says right there. dont do it. im sure confiscation is only the start of the problems you will have if caught with one
military or police personell are allowed to carry such items. But i know for a fact that there are some rather significant fines to follow

assisteds are legal i carry them all the time. they wouldnt sell them at wally worlds in pa if they were illegal. haha

Hello,

I've been reading for a while without posting, so forgive the lack of introduction.

The statute referred to by sixstrings is correct. The grading is a Misdemeanor 1, which is just below a felony, making this a serious offense. However, the penalty depends on multiple factors: 1) The volume of criminal cases in the county of the offense; 2) Any existing criminal history of the offender; 3) Any aggravating circumstances under which the weapon was carried and/or employed. Giving consideration to these factors, one may sustain anything from a reduction to a summary offense (about equal to a traffic ticket), to a pressing of the original charge, which may include (as already stated) hefty fines and even imprisonment. Bottom line (again, as already stated) is DON'T DO IT!

Besides, there are many makes of pocket/tactical-type folders that will open with the flip of the wrist because of the quality of construction. I have a Klotzli that is constructed w/ a teflon-coated cam and designed by Michael Walker, that opens as quickly as any swtch-blade I've encountered.

Incidentally, owning and collecting in Pennsylvania is another case. One may pretty much collect any knife, so long as it is possessed "solely as a curio". In other words, for the sole reason that it's a cool collectible!

p.s., I agree with sixstring also on the assisted openers, as long as there is a locking mechanism, such as is the case with the SOG "Blink".

Thanks, sixstrings...

I've been a novice collector for about ten years, now, and have often gleaned helpful info from this forum when researching purchases. I thought I should join and maybe reciprocate when possible.

Among my favorite knives are a Randall Mod 25 Trapper that I carry in the field, and a Lightfoot Catchdog that I carry as a CQC back-up at work (hope I never have to use it).

Thanks again for the welcome.
