Petition for clarifying what the FL law is on common pocketknife's.

CALLING FOR LEGISLATIVE CLARIFICATION OF FL. STATUTE 790,001 (13)


The following petition calls for legislative clarification of Florida statute 790,001 (13) seeking a definitive statement as to the legislative definition of "common pocketknife " and it's intended meaning from it's legislative creation in 1901 to date. Legislative action is clearly necessary to : (a) comprehensively inform the citizen's of Florida as to what constitutes prohibited conduct and (b) as is evidenced by the complete state of confusion the judicial branch of government has made in it's unguided interpretation of the term "common pocketknife " legislative clarification is necessary for the proper administration of criminal justice.

Sandi, I think it's clear from your previous threads that we all feel sorry for your family. Unfortunately, my sympathy does not extend beyond that. My parents were burgled a couple of years ago and I can tell you that if I could have killed the slimes that did it I would have--without one seconds delay. If your brother gets out finally I hope he can keep his mitts off of other people's property. Otherwise he'll end up shot. Eventually he'll find a slick lawyer or a soft judge who'll let him out. Consider that a gift. If he begins stealing again he'll end up dead. Things are different today than they were when he went in. Until then, I'm hoping he stays exactly where he is.

I don't see what it would hurt to sign the petition. I would if I lived in Florida. Looks like an old law that hasn't evolved with modern day knives.

And for a soap box. the laws against switch blades need to be reviewed. Many new one hand openers are as fast as a switchblade to open. I can open and palm a 110 almost as fast. down off the soapbox....
 
oops....maybe there is something I didn't know here....as usual.... But aside from any other scenarios. A lot of the old laws need to be changed.
 
your talking about a now fifty yr. old, going out to steal again, it cost something like 30 k a yr. to house a guy in prison, but a killer. rapist or child molester, will get out eventually and kill again. we need to use common sense. he did his time, while white collar criminals who a steal millions get off relatively Scott free, we know he was an idiot with a drug problem, but never a violent criminal,

It will actually cost a lot more than 30k a year to support him if he gets out. Since pawn shops and fences only give a small percentage of the market value of stolen goods, he'd probably have to steal $200,000 worth of TVs and stereos from our homes to make the equivalent of 30K a year. Maybe if he gets out you could give him 30K a year out of your own pocket so that he won't have to steal any more.
 
He is "only" a thief,NOT a violent criminal AND he has a drug problem!!He got a raw deal with the pocketknife!SNIFF! Try returning to your apt,have it ransacked & things taken(thief probably needed the $$ HE had a drug prob).So I have to take my hardearned money & buy to replace what he stole??Or get up to go to work & find your car on blocks cause all 4 tires have been stolen!! Or return to your car & radio & CD stolen!! As for a DRUG PROB.that was HIS choice,as was STEALING!! Now "I" should be sympathetic??HE WAS CAUGHT STEALING,I have NO feelings to help him in ANY way & using the EXAMPLE "THEY" could use "the small knife as a weapon"against us?? I refuse to be USED to aid his cause in any way!!
