Hey all. I know everyone here doesnt know me too well yet but i consider you all my friends anyhow. Forgive the non-knife content of this post, but my wife and I need some serious prayer. Today while we were at church, the apartment above us sprang a massive leak and flooded their apartment with 3 inches of water. THe maintennance team assumed it wouldnt leak into our apartment and thus never contacted us. well, it did and we have excessive water damage to our ceilings, walls and carpet all over the apartment. it leaked in every room. we lost furniture and most troublesome, our wedding and honeymoon pictures (Got married 8 months ago). Its a huge mess. i was able to get my guns and knives out before they became damages thankfully (in a safe so they stayed dry). THe apartments arent fessing up to their mistake of not contacting us and refusing any compensation at this point. Please pray for us. Thanks all...

Man that SUCKS!!!!

Hope all was not a total loss with the pictures,but maybe you could contact the photographer and get some reprints...

Be happy to include you in our daily prayers but......you need to see a lawyer right now. He can explain to the complex the difference between "Act of God" and Gross Negligence".
Don't wait. The longer you wait the colder the case gets. You should be able to find a good lawyer to take the case on a contingency basis.

That's a real shame what happened to you folks! Get a lawyer. We had the same thing happen when we rented a house years ago, the basement flooded the first night we moved in. We lost practically all our pictures and a lot of still boxed up household goods. The scumbag landlord lost the house back to the bank a few days later, so we figured we were just screwed. What was really bad, he told us the basement stayed dry, but the nest morning we found our posessions floating in 3 feet of water after that night's big rain. Bad, huh? Well, at the end of the month, we received eviction notice, the bank owned the house. I was enraged, so I called the bank and explained we had just moved in and paid 2 months in advance. The bank apologized, and told us to stay put and just pay them the rent. Good. Next day, the scumbag showed up, trying to collect rent again! I found out through the bank there were felony warrants out on the guy. I called the cops, and they arrested the guy. To top it off, he claimed to be a Minister of a Chruch in Davenport, Iowa. Two Churches were looking for him for embezzlement. Three months later we packed it in, counted our losses, and moved. Good luck, fella, our thoughts are with you all.

who didn't think about contacting you? those are the ones to get something in writing. then

I'd tell the owner you will see a lawyer and you want something in writing NOW
or the lawyer will do it for you..remind them, it won't be cheep either way it turns out.

the only problem is they can say what they want without proof
and if you are renting, is it up to you to have renters insurance?
that would be for contents..

If the apartment building manager knew of the problem and chose not to inform you; they are liable for neglagence. I am not a "sue happy" person. I have never sued in my life. But that never happened to me either.
 
Renters insurance is not a must Dan. He needs to contact the owner/manager right away. They are the responsible parties since the workers were in their employ or under contract to them. Even if the tenant above had called the workers, the management is still responsible. They in turn have insurance. Their insurance company is much more likely to pay the claim and go after the workers if you are represented by an attorney. Lawyers are a PITA....until you need them.

If the leak was due to a building defect the only people liable are your landlords. You need to check your lease/rental agreement to see if you signed away some of your rights. On the other hand many states have superceding regulations. So, think lawyer and think on suing the landlord and his agents.

I just got out of a leaky apartment into my own house this October.

We had to fight the landlord every step of the way, including the retailitory eviction from reporting her to the town and courts. It was a daunting task but my wife supported me and I her every step of the way. We won and recieved damages and punitive damages and our deposit.

What lies ahead is scary, but do fight for what is right.
