Proposed Texas knife laws.

Two changes to knife laws, now in committee, are HB1299, state preemption of knife laws, and HB936, which would mostly decriminalize switchblades. However, as I read the text of HB936, it would outlaw automatic firearms and suppressors. Now, they are legal as long as federal law is obeyed. HB936 does not contain that language.

HB1299 is in the Urban Affairs Committee.

HB936 is in the Criminal Jurisprudence Committee.

HB936 is now dead and has been replaced by HB1862. Th language you are concerned about regarding sound suppressors and machine guns is not relevant because of the exception as excerpted for the Texas penal code below. Essentially it says machine guns and silencers are legal as long as they are owned in compliance with federal law. HB1862 does nothing to change that. Please see below sub para "c"

Sec. 46.05. PROHIBITED WEAPONS. (a) A person commits an offense if the person intentionally or knowingly possesses, manufactures, transports, repairs, or sells:
(1) an explosive weapon;
(2) a machine gun;
(3) a short-barrel firearm;
(4) a firearm silencer;
(5) a switchblade knife;
(6) knuckles;
(7) armor-piercing ammunition;
(8) a chemical dispensing device;
(9) a zip gun; or
(10) a tire deflation device.
(b) It is a defense to prosecution under this section that the actor's conduct was incidental to the performance of official duty by the armed forces or national guard, a governmental law enforcement agency, or a correctional facility.
(c) It is a defense to prosecution under this section that the actor's possession was pursuant to registration pursuant to the National Firearms Act, as amended.
 
Unfortunately it is just more smoke being blown up in Austin. We in Texas would be better off if the legislature were to be banned.

That may be true, but the legislature isn't going anywhere. So, given that is the reality, it is in our best interests to work to make things better when we can. Or, would you prefer things stay the way they are? Your emails and calls to legislators do make a difference. Help us improve things for knife owners by supporting our legislative initiatives.
 
I wish they'd remove the blade length laws too! But legalizing automatic knives would be awesome.
