Hello, Just received a notice that I need to purchase a Dealer's Membership. I've sold only three knives and advertised a couple more since I re-entered this Forum in June/July of this year. I don't advertise or even have a retail website.
I mostly provide medic assistance to State and Federal officers. I have a Manufacturer's SOT and FFL and sell firearms to public safety. At this point in my life 68) I'm trying to sell some of the hundreds of collectable knives I've accumulated over 35 years. None of my sons are interested in the collection and have their own lives and jobs now.

I talked to my finance company and I have the ability to use credit cards online now. Do you want me to sent you an invoice link so that you can pay or would you prefer to do it over the phone?

Statements like above definitely lean more towards a business than personal.

But if he uses credit cards for his separate business, does allowing their use to buy from an existing collection make him a dealer if he's not buying knives currently for resale?

Statements like yours definitely lean to presuming and not informed.
I have the ability to take credit cards on GunBroker for a firearms sales business and can offer that to people here. I'm not in a for profit knife dealing business.
It's really no problem. I can advertise elsewhere. Just thought some folks here might appreciate some name brand knives at a fair cost.
Your Dealer Subscription rate is ridiculous.

Not hard to presume when your for sale thread reads like this.
Benchmade 2550 Mini Reflex Automatic Knife.
$219 plus you pay for your choice of shipping. $7.00 for a new type of First Class Mail that has the word "Ground" in it or we recommend a USPS Priority Mail Small Flat Rate box for $11.00.
The Benchmade 2550 Mini Reflex has a matte satin finished blade with a plain cutting edge. The handle is black anodized aluminum with a tip-up pocket clip.
This knife is out of production and is considered a collectors item.
Knife is brand new and has never been carried or used for anything. Original Benchmade factory box is a bit worn from storage in boxes with hundreds of other knives.
We
can accept payment by credit card ( we can send you an invoice to pay by credit card), USPS Money Order, Bank cashier's check (No Personal Checks accepted). No PayPal accepted at this time.
The US Postal Service has changed the name of "First Class Shipping to something different with the word "Ground" in it but our packages seem to be getting to people from our Alaska location just as fast as First Class used to. If you're really concerned with shipping time, opt for the "Priority Mail" selection described above.

We will not ship to restricted cities or states, please be aware of you own local and state laws.

I mean, individuals who own businesses can still sell as individuals, but when you post that you're taking payments through your business and shipping from your business, it does kinda blur the line. I can understand the OP can reasonably disagree since it's not part of his business inventory, though.

If he’s recording it through his business, he gets the tax advantages.. therefore he’s a dealer IMHO. If he was buying and selling as an individual, didn’t use “we” in his ads, and didn’t have some copy/paste spiel about where he ships to, then maybe. All signs point to “dealer”.

Everyone wants to be a dealer, but no one wants to be a dealer.

Yeah, if it was on the books as business inventory, that would be the case. A lot of sole proprietorship LLCs are bad at separating personal and business, I think, and I suspect it's mainly that's what's going on here rather than a deliberate attempt to skirt the rules. I'll accept on face value that he's just moving his collection.

Who in their right mind would want to give an individual (not a business) their credit card information?
Anyone with a reasonable level of intelligence who has a quality credit card. All credit card companies provide excellent fraud protection, in case of a bad deal you are totally protected. I don't think it's quite the same level of protection with debit cards.

Well, Mr. presupposing and threatening person... the WE is myself and my son with regards to our firearms business. I don't sell knives through the business, they are from my 35+ years of collecting. I'm getting older and don't need so many collectable. Yes, we can use the gun business credit card processing program to take money for knife sales. Just offering to make it easier for customers to pay however they want.

You literally just said you and your son run a business, and you presented yourself as such here on this forum.. and you still want to claim you aren’t a dealer?

Correct, only the guns are on the FFL and SOT books for the gun business. The knives are my personal collection and it's time to move them. My kids are all grown and although my oldest helps me none of them are interested in continuing the collection, or the gun business for that matter. I/we are liquidating most regular and SOT guns and suppressors.

Yes, that's exactly what I'm saying. What part of the knives being my personal collection don't you understand?

I understand that even dealers can have private collections, but you have to also look at things from how they appear on our side of the mirror.
(And it's not like we haven't been down this road a time or two with others who may have had less integrity than you.)

I'll go stand on the sidelines for now...
