Recommend a knife attorney in NYC?

Hi guys,

I got into trouble with NYC knife law - was just picked up in the subway carrying a SOG Aegis knife and charged with carrying an illegal weapon.
One of those things that you never thought could happen to you...

Can anybody recommend an attorney specializing in such matters?
I will probably also need him to deal with whatever happens with my rifle license - I am sure they will pull it at some point because of this charge.

I will appreciate references.

You don't need a "knife attorney", but rather a criminal defense attorney. It is highly unlikely you'll find an attorney that "specializes" in ONLY the NYC knife law and its jurisprudence.

You could start with the NY Bar Association attorney referral service (seeking a criminal defense attorney). There are also private referral services like Martindale-Hubbel. And if you're feeling especially tight on funds, you could see if area law schools have open/walk-in law clinics (run by a clinic director attorney, and staffed by 2nd and 3rd year law students).

Sorry to hear you have gotten caught up in the fiasco.

Yes, your rifle permit will be endangered by this bogus arrest and so this is a bigger deal than normal.

As Chuck said, you need to contact us ASAP. We are three hours behind East Coast time, so please don't call before 9:00 AM your time. I will be traveling Sunday, so call Saturday so we can get started on helping you understand the issues and referring you to competent legal representation familiar with these knife issues. (I also emailed you via Blade Forums)
 
DUDE.. that sucks =(...

I live in new york city aswell.. BECAUSE of these car-bomb Sept.11 threats they have upped the security and bag checks... for the past week now ive not been carrying a single knife, and not to mention i wont for a week after ( only will carry 1 at work and in my home) ill start carrying once again when the "cop watch" goes back down.. lol

Ive decided not to carry a auto or assisted in the city as i hear (and sorry to say) but it makes it ALOT worse if you get caught, as opposed to a knife that flicks out just as fast but not auto or assisted.. i just sold my aegis, i dono which model you had i HOPE it wasn't the tanto/serr model in black... that can be hard to fight... With all of these sheeple people we have in our court systems... Maybe they dont understand just because they sit on their asses all day in an office pushing papers dosn't mean everyday people such as You and Me dont need a knife for our chores/work..Really annoys me man...

I wish you the best and hope they dont take ur gun license away!!!.. ontop of that i'd like to say that MOST of the cases reguarding knives are DISMISSED without a testimony... Ive talked to several NYC police officers.. they said they just wana get knife offa the streets.. so they dont hold up the court system with you, you go, and they see you there, before any1 says anything the judge will announce that you are dismissed along with the charges.. your license will not be effected and YOU WILL loose the aegis.. but a cheap knife anyway..

Would suck if they found me with my SNG or SMF... 0.0

Wish you the best of luck, I hope this gets resolved. Again, it saddens me to see our rights to carry getting trampled. I sometimes take for granted living where I do, I can't imagine being afraid or unable to carry.
 
First they do not always so quickly dismiss charges. You have an obligation to notify the Firearms control section in Queens ( the issuer of your NYC Rifle & Shotgun Permit) if you are arrested, failure to do so can give them cause to cancel your permit when the charges are dropped or not ( check with your lawyer first). The NYCPD legal divison has declared assisited openers to be switchblades and this was re stated as recently as a month ago in a retail store operation. Good Luck and keep us posted. Do you have a fishing ( or Sportsman license), if so where you headed to get your fishing pole and go fishing? I can assume you were charged with 265.01 or CPW4, This is the state law and allows for the carry of this type of knife for use while fishing, hunting and trapping but it does not demand that you are going directly to and from those activites as the NYC Admin code 10-133 does for knives with over a 4" blade. Where you given a pink summons or a DAT?

Here is the section of the Admin Code that requires notifiction:

e) The licensee shall immediately notify the Rifle/Shotgun Section by telephone, followed by written notice within ten (10) calendar days, of any incident or violation of law or
Title 38 RCNY Rev. Nov. 2010 Page 4
rules of federal, state, or local jurisdictions regarding her/himself, partners, officers, directors or stockholders of the licensed corporation or entity, or affecting the premises or business operations. For purposes of this subdivision, an incident includes:
(1) arrest, indictment or conviction in any jurisdiction;
(2) summons (except traffic infraction);

This is under the dealers license section, but if I remember correctly they state the same in the info package you get when your license is issued, and every employee of a dealer must have an indivual R&S permit. Once again run it by your lawyer, but I would hate to see you loose your permit due to a notification faliure on your part. I have seent his happened to a pistol permit holder I knew.

First of all, I would get that rifle out of NYC. Leave it with a relative or friend who lives outside of the city. If your firearms license gets yanked, the cops will be at your door to confiscate your rifle and ammunition. If they find anything else in your home that is illegal (another folding knive that can be flicked open, for example) during the confiscation action, you will be charged with that also and your legal situation will go from bad to worse.

FWIW -Why on earth would you carry something like that in the subway KNOWING security has been upped ten-fold in the past week?

Bad things happen to good people all the time. It's just like losing a really nice knife in the woods, sometimes things happen.

We have a rifle/shotgun license here in MA also. It is called a Firearms Identification (FID) Card. My guess is that the OP's pocket clip did him in.
