Since the subject has cropped up on this forum in another thread, I would like to make some remarks that I hope will answer a few questions in advance of any additional threads or inquiries being posted about this matter.
Suffice it to say, the release of this article greatly disappoints all of us at ATC for a number of obvious reasons that have been discussed on this forum and elsewhere, at length. They do not need to be revisited.
I have personally spoken to Steven Dick, Michael Janich, and our attorneys about this article. It is ATC's assessment that the article falsely adds credibility to many of the claims made by the Hayses within the context of the ongoing legal action in Federal court between our companies, which in many respects are a reiteration of the claims they originally made here at BladeForums.com in early 2002. Many of you were privy to those threads and know the situation.
Michael Janich is a professional in our industry with what I feel is a well deserved and an excellent reputation. He continues to have my respect and admiration, despite this article. However, in no way does the article change its subject's relevant history, just as the article does not change Michaels solid background and qualifications as an author.
I knew that this story was slated for release in TK at this year's Shot Show. At the time, I suggested to TK's editor that the lawsuit be allowed to conclude before releasing an article that would create problems on a variety of fronts and complicate ongoing legal matters. In this way, the dispute would have had closure to the industry's satisfaction and its outcome would have either substantiated or refuted the Hayses claims.
While ATC's position on the entire affair is no secret, at minimum, I thought this was a fair proposal that would allow TK the neutrality it so desired regarding this dispute. TK's position in my view is impossibly neutral at this juncture, due to this article.
As a result, appropriate actions have been taken to notify Harris Publications and its relevant personnel of ATC's assessment in terms of this articles repercussions. The LaGana family is also involved in issuing those notifications.
Should anyone be interested in sharing their perceptions of this article via e-mail to me at andy@americantomahawk.com, I would welcome those comments and advance them to our attorneys for their edification.
