man this is a tricky one ,,i just got my delica taken from me by the nypd a few days ago...he tried to flip it open and couldnt ,, still said it was a lockback so he kept it ,,

The Delica IS a lock back. That is why they took it from you.

The Dog Tag Folder does not lock from what I understand.
 
Folks lock backs are NOT illegal just because they lock.....The officer who took your knife was wrong and his illegal actions should be reported. Why did you get stopped with it in the first place?

A fair question, Tom. I have been reading case law and court transcripts on knife arrests for years now, and only one time has there ever been a stop and search on an individual who was not committing a crime or otherwise acting obnoxious or suspicious. Of note is the defendant is sometimes a bit dishonest/in denial about the circumstances of the police encounter. One at least two occasions I read a forum member's sob story, then learned their real identity, then went and found their actual court records. e.g. "Waaaah, mean cop pulled me over for running a stop sign and took my knives!" Translated to "My registration was also expired, I have 3 prior drug offenses on my record, one of which I was on probation for, I was leaving an area with known drug houses, I have long blond dreadlocks and I positively reeked of pot when I rolled my window down."

Keep in mind, I do not generally count cases in New York City in the above statement, because they have a "knife in plain site" prohibition, a somewhat unique kind of law, so a frequent reason for encounter is visible pocket clip or hanging from a keychain.
