Spring Assist Legal in CA?

Folks,

I bought my grandson a very inexpensive "1st Knife" spring assist knife. (Rough Rider) that is... yeah yeah I know.... He lives lives in CA. The blade length is 3.25". Is this legal in all municipalities? Just wondering as there is no way he will receive this POS, I am sorry but I am sure this topic has been discussed time and time again, but I have run out of patience here and would appreciate some advice...

It was bad enough when I read the box label about "Causes Cancer in the state of CA", I suppose in the other(49) States its safe.... Shameful tactics by the seller as well as Rough Rider.... (See how cleverly the text is Disguised in the 2nd picture below, keep in mind its a macro pic) It is amazing that products like this are not screened better, Yeah what am I thinking in today's world?

Don't get me wrong, My godson is destined to inherit some big time knives in short order as I pass...... But! His name is "Nick" and he loves Zombies...... This gift was supposed to be his first knife but I think not!

This piece of Shit is not worth putting a USPS stamp on, Oh well!

I suppose I just have bad luck... TD


 
It is legal to possess any size of knife, folder or fixed-blade, in every city and county in the state of California.

Carrying is a different matter.

Some cities/counties like Los Angeles have laws that prohibit the OPEN carry of any knives with blades 3" or longer (yet the concealed carry of any size of manual folder is perfectly legal, odd but true). And there are exceptions to the 3" blade length limit, like if you are carrying the knife for legitimate work related reasons, or legitimate recreational reasons (fishing, camping, etc), and you can prove it.

Naturally, where one lives/visits/travels in California will determine what knife laws apply to them.

There are also state wide blade length restrictions on switchblades and butterfly knives, but the knife in question is neither of those. Spring assisted knives are perfectly legal to possess and carry throughout the state of California with no specific blade length restrictions (with of course the exception of those cities/counties that have open carry size limits).

As for the cancer warning, it's meaningless. They passed a law here in California awhile back that basically says if there is any substance in a product that is known to cause cancer, etc, that a warning must be provided. It could be whatever lubricant they used on the knife, or the paint, or some chemical used to make the plastic handles (if they are plastic).
 
Sorry the RR knife is not going to work. There are other "zombie themed" products available with better quality as well.
I live in Berkeley California and EDC 24/7/365 with a clip showing and have never been approached or questioned by LEOs. Most of California is pretty allowing as far as knives go. You can own anything you want but a few items cannot be carried in public. Most areas allow blades 3 inches and under BUT some cities like LA, SF and even Berkeley have their own restrictions. Spring assisted is OK but autos need to be under 2.5 inches I believe, you will need to check to be sure. Balisongs are OK to own but not to carry.

Here are some KaBars that are zombie themed. Probably a decent product for the money.

Some types of knives are completely illegal to possess/own in California, like knuckle-knives, belt-buckle knives, ballistic knives, plastic/undetectable knives, and basically any item with a knife blade hidden inside of it (cane, lipstick tube, pen, etc). (California penal code 16590)

If they're not worried about it in Berkeley, you're good!
But seriously, I concur with billym. The only way you're very likely to get into any sort of legal trouble carrying a knife is if you are a known gang member, or on probation / parole or something like that. Even then, just don't carry a butterfly knife / balisong or an automatic and you're pretty much golden.
 
The California law allows the carry of assisted opening knives of any size ( switchblades and balisongs must be under 2.5" in blade length to be carried, and anything larger actually has to be transported in a locked case )
But some city's do have their own restrictions.


One suggestion before giving it to him is to take it apart and locktite all of the screws.
From my experience most cheapo assisted openers would be perfectly serviceable if they didn't fall apart after a month.
Sure You can check them Everyday and tighten any loose screws, but the hardware quality is always very low and they strip out easily.

Locktite that sucker and it should be fine.
 
Yup, spring assist ok. Some cops might think it's an auto. Most don't know the difference believe it or not.

Seriously locktite it and it won't be that bad. At the very least he'll be able to fidget with it all he wants without it falling apart.
If you want to get him a much better first knife that's worth using, the victorinox tinker is often round for 20-25$ and the buck 482 is 20$ and was in my pocket every single day for 2yrs ( the blade forums made me want to carry some knives I hadn't carried ) and the bantams are just as good for the same price.
You just can't beat'em.

Thanks for all the comments guys! Perhaps this will be his first knife? His dad is super protective so I will consult with him first. He is a good kid so I am sure he would be responsible with it. TD

A first knife should be cheap so you aren't a mad when they break off the tip or lose it.
I bought my teen son a$200 Benchmade. If you find it please return it! Lol

My steering wheel cover has that cancer warning! I didn't know if it was a real concern or not.

Wow sorry to hear about the lost Benchmade.. Perhaps you might purchase him the same item when he gets a bit older,or now, and present him with it later, then he will have a cool story to tell... I am a Benchmade lover to the max, and although the crooked river blade is a bit large for my EDC I carry every day because it is so versatile. Best Regards TD

I don't think it has actually gotten lost yet, he's just saying that you shouldn't trust a ten with 200$ worth of anything
