Spyderco Knives in Toronto, Canda?

Hi all, I just recently purchased a Spyderco Delica 4 from a Toronto retailer. Is this type of knife legal to carry around on you or can the police declare it to be a 'gravity knife'. It has a hole in the blade and if I flick my wrist and flick the hole in the blade with my thumb at the same time I can open it with 1 hand. If I just try to flick it open when its closed without using the hole on the blade I cannot open it. Any additional information would be appreciated as I'm finding it difficult to find a solid answer to my questions. Thanks.
 
Hey Metafour: I also live in Toronto, and recently got a Delica 4--but from a BF member, not a retailer. It is a nice knife and I tend to EDC it. I think they are okay to own and carry, and isn't a gravity knife, legally speaking. However, life being the way it is, if a constable happens to see or find it on you, I bet he (or she) may take a different view, and possibly confiscate it--put perhaps because its a "concealed weapon" not because of the way it's designed to be opened (with the 'spydie' hole). But I think that's a low risk.

Its not a gravity knife. Its legal to carry around as long as its intended use is not as a weapon. Since you have to use the hole to open it when you flick it, its okay. BUT if you were able to just flick the knife open then there may be issues.

Thanks for the info guys. Matt if its in my pant pocket would it be considered under our law as a concealed weapon? I feel that if I walked around with something like that visably showing I would probably end up drawing more attention to myself and possibly getting into trouble.
 
Matafour, I don't know the precise rules around concealed weapons, but I suspect they are blurry: if for example a cop finds it on you after you've been stopped at a Ride checkpoint, and he's fishing for charges to lay against you, then he's probably going to say it's a concealed weapon. If on the other hand you politely ask a cop for directions on the street one day and--knowing a knife clip when he sees one--while chatting he spots your Spydie clipped to your pocket, he might either ignore it or just give you a polite warning. That's my two cents anyway: I'm neither a cop nor a lawyer.
 
it's nice to see more canadians in the forums
the police are generally more lenient here than america, at least in BC
as far as I know, no standard folder is illegal anywhere in canada. you are better off carrying a concealed folder than a concealed fixed blade, because in the cops' eyes, a concealed fixed blade is more a weapon than a tool
