SpyOpera lock defect

Has anyone had this issue with a SpyOpera? The lock bar is getting stuck in the raised position which causes it not to engage with the blade in the open position and also to not retain the blade in the closed position. I bought this knife used and I'm going to be returning it, but I'm wondering if I should get a new SpyOpera or if this maybe reflects a broader issue with the SpyOpera.

 
If it was new I’d say send it in for warranty. Being used, probably disassembled by previous owner and reassembled improperly!
 
I can't say mine has that issue. Have you tried a bit of lube? They use Wurth CU800 at the factory. It's a copper anti-seize. I'm sure any oil or grease will do the job though.

Thanks for the reply. I bought this used and have returned it to the seller. Your customer service is always great though so I didn't hesitate to buy a new SpyOpera from a reputable dealer and it just came today. No issues whatsoever. F&F is fantastic.
