Talon hole infringement again?

Not that I want to stir up some excrement, but is this an example of a patent infringement?

That sure is a cute little fighter :) But is it a lanyard hole or is it a "Talon Hole"? How does one tell the difference? I mean really, makers and manufactures have put lanyard holes in guards for a long time. What is the registration # on the Talon Hole trademark/patent. Maybe the paperwork filed lists how one is different from the other. I searched the trademark office one time before and only " Busse Combat" showed as a registered trademark.
 
from what ive read, the trademark for the front talon hole is only for that structure, the circular hole, with the circular surounding gaurd. if you make the surrounding guard square or pointed, it isnt an infringment. as to trademark info, im sure that if you call jerry, he could give you the information on it

I don't believe this is completely accurate. I believe the trademark refers to any hole in the front guard, and it makes no difference on the shape of the guard.

BTW, Jerry is already aware of this knife and the hole
 
well i hope the legal people file an injunction cuz I have one of these little guys coming in the mail and it might make it more collectible!
 
Let me clarify: it's wrong to profit off a trademark infringement. It's wrong to infringe on a trademark and although ER is made in Italy (and I'm not a lawyer) I'm sure they cannot profit from US sales by doing so. I actually ordered it before I read this thread, I just thought it was a cool little knife and I'm still waiting for a consulting check to come in so I can get a Busse to sling on my backback when I'm out hiking and camping.
 
Other than where the hole is placed, it looks nothing like any Busse. I think there was problems with other knives that had the same overall look, plus the talon hole. I've seen lots of other knives that have holes in the same basic area.
