Is the Tops Tom Brown Scout breaking the patent on the 'Talen-Hole'?

I think there has been some discussion of this before, but we are not privvy to all the legal niceties of Jerry's business. Strictly speaking, Busse does not have "patent" on the talon hole, it is part of the Trademarked design.
