All: on 12/20/99 my trial against my Sheriff in California is ON. This'll be a non-jury trial, I'm the plaintiff, I'll have lots of attorney "prep help" beforehand but no actual lawyers with me in the courtroom.

Despite that, I've got a real good chance of kicking large amounts of posterior. The issue is corruption, elitism and bias in gun carry permit (CCW) issuance.

What I'd like to do is open two threads a day or two before trial, one for "general discussion of the case" including feedback and questions, and one for live updates by me via laptop and wireless modem right in court on breaks. I'll probably have other local activists in the bleachers so if I'm too busy to report, one of them can use my rig and do so. The "live update" thread mustn't be overloaded because it'll be monitored by the local media, national-level NRA people and God knows who else. The very first message there will be a link to my trial brief, which by then must go to the opposition and Judge anyhow and will act as a "program guide" to the festivities.

These URLs will then be broadcast on a huge number of mailing lists, usenet groups and other web forums before trial. Glocktalk, Firingline, AR15, AK47, Tacticalforums, gunspot, talk.politics.guns, CA-firearms, MA-Firearms, WA-CCW, ConcealedGeneral, plus people will forward it god knows where. I need to know if 100,000 hits just to these two threads over a 2-day period is liable to crash the server and/or UBB! And yes, that kind of traffic is possible here, nobody has taken on the CA CCW issue in quite this fashion.

Second, if BF can handle it, then I need moderator access to the threads. They really belong in Politics, so I guess I'm asking for temporary moderator rights to Politics starting approx. 12/16 or so - I'll only use it on the two trial-related threads. Since I'll be busy with the trial itself as well, I could use some "backup" over there, either extra attention from Spark and Mike or a couple of volunteer moderators to keep chitchat off the "live update" thread and flames off the trial discussion thread which may get *enormous* and/or attract newbies who'll need more moderation than normal.

If BF can't take that much sudden hit then we'll figure something else out, it's not a problem. But I need to get this mostly planned out over the next week or so.

THANX!

If you're interested in showing up in person, the fun starts at 8:30AM in the Contra Costa County Superior Court building, Martinez branch, Department 13, Judge Richard Patsey presiding. EMail me for directions. A good crowd would be neat so long as NO CAMOS

No problem Jim. We can handle the traffic.
I will make you moderator of that section and I will look in as well.

Good luck Jim. I've looked at your web page and this seems to be something that needs doing. I'm with you (as previously said) in spirit. Don't know how much any of this helps but it is sincerely said.

Good luck Jim. My prayers will be with you.
Give 'em hell.

Jim, I wish you the best of luck!
I think the up-dates are a great idea but don't become so involved in telling us what you are doing you forget why you are there. You must win...that is your priority. Let someone else worry about getting the info out.

Believe me, Shappa, I haven't forgotten that. Doing quick notes like that should help me "mentally thrash out" what's going on. It may have some small impact on media attention, which is crucial for both strategy in this case and the overall statewide situation.

See, IF I can get some some major revelation into play on day one and it hits the morning edition of the papers on day two it could hasten a settlement or prod the other side into panic. If by some miracle I can get the media on my side after a win it might prod them into quick reforms versus dragging it through appeals. And since a LOT of other Sheriffs are screwing up in the same way mine is, my Sheriff might find himself pressured NOT to appeal to avoid a state-wide precedent such as happened in the Salute vs. Pitchess case.

In Salute vs. Pitchess, the guy suing Sheriff Pitchess lost the first round where I'm at, but won at appeals. Therefore it's now precedent.

In a case in upstate New York, Fed prosecutors lost a case on "pure second amendment" grounds not all that long ago, which was a shocker. The Feds deliberately walked away from appealing it rather than risk a precedent-setting appeals court decision upholding the 2nd and putting all gun control at risk. That's something we're worried might happen in the US vs. Emerson case; if that bad boy goes all the way to the Supremes it could shake gun control to it's core.

What I'm trying isn't based on the second amendment. I'm trying to use equal protection law to say that if the Sheriff's personal cronies and campaign contributors get CCW on a "just because they want it" basis, SO SHOULD I. To do that, I'm saying that they're violating a clause that relates to "privileges and immunities" - by ADMITTING that CCW in Calif is a "privilege" I'm agreeing it isn't a "right". Yes, this is dangerous ground, BUT it's totally new ground, there's NO PRECEDENT AGAINST ME that my court has to fight!

That's how I'm going to clean their clocks; I'm not talking about a right to arms or a permit, I'm talking about a right to EQUAL PROTECTION. They can't screw with that without undoing the entire civil rights movement.

The last guy that tried to claim a direct right to a CCW got shot down in flames in 1995. See also: http://caselaw.findlaw.com/cgi-bin/getcase.pl?court=9th&navby=docket&no=9455836

Jim...
What do you need from us over at TFL?

I would wish you luck, but luck shouldn't be an issue in a legitimate dispute in a legitimate legal system.

I think that what you need is a person who will oversee your case with an unbiased, non-political minded clarity. That would be justice.

I hope you find justice, for yourself and your fellow countrymen. Your cause is just, I hope the system can look at the issue without caving in to the paranoid and loud minority.

(What the heck, good luck too!)

HI DC, good to hear from ya. I'll be putting out "party invitations" to TFL and a whole lotta other sites soon. I considered spreading the load on the threads between BF and TFL but since they're on the same server that don't seem like it'll do a lot of good.

Jim

It would be best to do it in one location. That why the conversations flow better. We can easily handle the traffic as we are now running at only 15%-20% of our server capacity. Our server gets nearly 1 Million hits a day with all the sites we have on it. Which is about 50 right now.

Everyone is welcome here. And I just turned on your moderator status on that forum.
