A 15 year old boy was arrested today for stabbing his sisters 17 year old boyfriend with a knife. The 15 year old went over to the 17 year olds house to find his sister when he got into an argument with the older boy. The 17 year olds father came out of the kitchen and started to confront the 15 year old when the 15 year old pulled out a 3 1/2 inch folder and stabbed the older boy three times. The older boy suffered chest, neck and arm wounds but is expected to survive.

An investigation is in progress to see if the 15 year old purposely carried the knife for a confrontation or always carried it and feared for his safety. The 3 1/2 inch knife would mean assault with a weapon to cause great bodily harm since in Lakewood it has to be a 4 inch knife to be assault with a deadly weapon. Also under investigation is the fact that NO knives are allowed on school property and if the 15 year old came directly from school or went home first and got the knife. Because both are minors, their names will not be published in this report.

interesting. i would think a charge of attempted murder may be in order.

would depend on what the "victom" did if any thing. If a larger person makes threats against a much smaller person and is then stabbed by the smaller it may not be consider asult and simply a case of self deffense.

Personally for me a knife would be my last choice to deffend my self. Not because i am unsure of my skill with a knife because well lets just say im far from unsure. But fact is i dont want to be killing or maming some one needlessly. Id make a really crappy cop lol.
 
It seems like a pretty difficult case for the 15 year old since he went to the guy's house with a knife. He'll probably get scared with threats of charging him with attempted murder to convince him to accept some lighter charge. It worked on me when I was 16 (I didn't use a knife, but the weapon was considered deadly since it was illegal in the state).

ignoramus hit the nail on the head. the teen went to the other boys house, regardless of what happened afterward, bottom line is he went there with a weapon. intent is implied.

it would be very difficult to argue self defense in anothers home, seems the teen may have created his own exigency.

Well it said he went there to pick up his sister, but that may be a lie... I wouldn't so much say intent is implied, because after all I always have my knife on me, not for self-defense purpose, or for killing someone, but for cutting open boxes and stuff.

Same here. If i forget my knife im always checking my pocket and feeling for where it normally is. Just because he went some where with a knife does not show intent. If he went there to pick up his sister and just had the knife on him it is possible the victom attacked him. Regardless it will be a complex case no matter what. As was said it happened in the victoms house. Now if he normally did not carry a knife with him and only carried it this time for potential self deffense or planned attack then hes in deap dodo.
 
article says he went there 'looking' for his sister, not necessarily to pick her up. there is no indication from the article, albiet it is brief and lacking detail, that the victim was armed or presented a physical threat. or that the suspect was even invited into the home.

agreed that more details are needed.

from a 'probable cause' standpoint, intent here is implied, or general.

and lets not forget, that in lakewood, ca (se of los angeles, if its the same one) a minor cannot possess a weapon in public.
 
Again more details would be better, but I'd like to add that it's possible that they can make it seem like the "looking for the sister" was just an excuse made after the fact or in order to confront the 17 year old in the first place.

we will probably never get more details, since cases involving minors are normally kept confidential.

but prima facie it looks like the kid went looking for a confrontation.

LAKEWOOD - Authorities filed an assault with a deadly weapon charge Wednesday on a 15-year-old boy who allegedly stabbed in self-defense his sister's 17-year-old boyfriend, a Los Angeles County Sheriff's official said.
The incident occurred about 9:30 p.m. Monday at a house in Bellflower in the 1600 block of Cornuta Avenue, where a dispute took place between the two teenagers, whose names were not released because they are minors, said Detective Rudy Ramos.

After the victim's father and brother came out of the kitchen they started beating up the suspect and his father, Ramos said.

During the fight, the 15-year-old apparently pulled out a 3.5-inch folding knife and stabbed the 17-year-old four times - in the neck, upper back, left rib cage and the right side of the stomach, Ramos said.

The victim had surgery Tuesday and is expected to survive, Ramos said.

In the meantime, the suspect is being held at Los Padrinos Juvenile Hall and may be tried as an adult.
 
So the suspect's father, the victim's father & brother were also involved? I'm a little confused.
 
great outlook. so i take it you are still in oakland? i know a guy who used to work for oakland pd. he has NO regrets for leaving. :D


I moved out over a year ago. I'm in a city next door and still have friends there, so I go there somewhat frequently. The city is a dump, and I don't regret moving out, though I do appreciate being able to experience some things that may be considered extreme to people living in areas with less crime. It's pretty hard for me to get scared nowadays (in terms of violence). I do talk from experience in some degree when I discuss SD.
