Venomtech = fixed blade?

I was drooling over the soon to be released line of Microtech Venomtech 5.5" OTF autos. Something struck me, about the 2" that protrudes from the grip. Would this constitute a fixed blade? Legally? It's got a neck sheath due to the 2" protrusion. A fixed blade knife that extends. Awesome concept.
