Verdict in BurrKing Tru-Grit Lawsuit!

Well mark one up for the goods guys! Sorta.

For those not following the situation. A pudthumper sued Tru-Grit and BurrKing after he seriuosly hurt himself in one of the stupidist grinding accidents I have ever heard of. He was sueing Tru-Grit for not finding out if he was qualified to operate the machine before they sold it to him. He was also sueing BurrKing for selling a machine with a dangerous design and for not listing a warning not to do what he did.

The Verdict is in!

Tru-Grit has been totally excused of all fault and found totally innocent in the case!!!!!

BurrKing was also found to be innocent of the charges of producing a dangerous machine. However the court did rule that BurrKing was partly to blame for not having warnings listed not to do certain things that might case injury or death. The court found that the pudthumper was 15% to blame for being a moron and that BurrKing was 85% at fault for lack of instructions. The court awarded $200,000 to the moron. Which after all is said and done not really all that much.

Now for the good part! The court did not place any gag orders over the case so I can finally release this donkeys rears name.

THE BUTT HEAD IS JOHN DACONEICAO. His makers mark is "JMD".

At this point I am taking a public stance of distain for Mr. Daconeicao! He claims to no longer be making knives. However if he is, I will not be attending any shows that allow this maggot to have a table. I would ask that any makers who feel the same to make thier thoughts known as well. This a-hole was looking to put two good companies and one very fine man out of business. He deserves the same action from all of us. If he ever sells another knife I will be very disappointed!

R.W., thanks for the update on this story. I almost forgot about it. A$$holes who try and sue to cover up their ignorance are crap. they are the people who point at everyone but themselves when something went wrong.
 
I put him on the same level as the woman who sued McDonald's because her coffee was too hot :rolleyes:

Gawd...I had a Machine Shop safety class just yesterday, mills, lathes, and such...even engineers need training apparently...;)

I printed out the story below and took it in to our (40 years+) Master Machinist 'Bill' today...he laughed, then posted it over the Burr-King...lol

Oh God, why did I read that, I'm still cringing. I saw ZENGHOST post how nasty it was but I read it anyways :barf: :barf: I'm going to wear a steel cup at all times now;)

I think it's pretty sad that the "pudthumper" got money for his own negligence:rolleyes: Some people just can't accept being wrong I guess.
 
The next tiem you go buy a grinder, there will be a big sticker on there saying:

WARNING! Not for self-gratification! If you don't know what this means, youa re too dumb to operate this machine!
 
This is good news. John and his family are some of the good guys in the world or knives. Now I sincerely hope Burr King gets back to making their 960. I love that machine dearly.
 
This is incredible. Living in Sweden where we have very different laws (getting cash through lawsuits is almost impossible) about things like this. I´m amazed. HE bought a machine, HE didn´t know how to operate, HE hurt himself...

He gets money from the company that made the machine because HE is stupid? As I said incredible.

Thanks for the update! I agree with you 100%! It's hard for me to believe that the court awarded him anything at all! People like that cost everyone money making products more expensive than need be just for liability insurance.

Sounds like the kind of case that makes even most lawyers sick. There was the woman at the gym I used to go to who claimed no one told her not to put her finger under the weight stack on the machine while the weights went back down, and I think I once heard of someone who reached under the lawn mower while it was running and then claimed there was no warning sign.

How did the guy hurt himself?
