Web Specials and Taxes

Hey guys. I placed an order for a couple of web specials. The order exceeded $50 so I saw I was not going to be charged for shipping and handling. However, when I did my cart checkout, I saw I was being charged sales tax on my purchase. I live in California, so why am I being charged taxes on an out of state purchase? Anyone know? I went ahead and placed the order anyway because one of the knives I ordered was a 110 diamondwood 154cm model and I didn't want to miss out on it. I figured I would just suck it up since I wasn't being charged for shipping. Prior to completing the order, I verified my address was showing California, not Idaho. Is this normal when ordering direct from Buck, or could it be an error?:confused:

Maybe they still have an office or something in Kali, that would mean that they have to charge you the tax. Or, it could be a computer glitch that wasn't fixed. I would call and ask though so you know the deal.

I order less from Amazon now since I'm in ny now and they tax me now. So, I can appreciate your concern.
 
Some states charge sales tax on internet orders even from out of state.

My state of Illinois does if the order is placed with an online store inside Illinois, but not if from outside Illinois.
 
I am in CA also and paid tax figured it was just the peoples republic of Kalifornia :rolleyes:
 
Buck still has Wilde Bill making knives here in CA... So I think that's why we paid sales tax... :grumpy: :( :thumbdn:
 
It's the same if I order from Bass Pro or Cabelas. Because we have retail stores in state, I'll get charged sales tax even if what I order does not come from the store in state.

Tom, I'm not blaming Wilde Bill... I wish I new why we get tax on Buck knives... Maybe they still have a office or something here, beside Wilde Bill... Like ohen cepel said... I think I will call Wilde Bill tomorrow and ask him... ITE ... :D

Your CA Board of Equalization has Buck collecting "use" tax on your internet purchase from buck, a seller with nexus, physical presence, in Idaho. You paid California tax.

Use tax is the mirror image of sales tax. Semantics really. Use tax keeps buyers from beating sales tax when then buy something out of state (where little or no sales tax is paid on the purchase) and use it in their home state, when their home state has aggressive sales tax.

Counter point: Quill v. North Dakota, 504 U.S. 298 (1992). A US Supreme Court case relevant to your position. This ruling goes against what CA has done to you.

PS. I recall paying sales tax, not sure to which state, on a prior internet purchase from Buck. I reside in a non-sales tax state. Probably someone hit the wrong button. Whatever.

I think oregon has it right. Now that its been mentioned in this thread, I do seem to recall California passing some kind of law that lets them charge sales tax on internet purchases out of state :barf:. I'm gonna have to figure a way around that........
 
From what I was told when i asked about it, if they have a distributor or official (Company) dealer in your state then they have to charge sales tax just like if they were based there. For instance there is a Buck distributor somewhere here in Florida, so I would also get hit with the sales tax.

You could always have someone you REALLY trust in a no-tax state order them and ship them to you.
 
I've done online sales of Silver coins to California and wasn't required to charge the buyer Peoples Replublic sales tax.:confused:
