Im thinking about selling my Microtech mini SOCOM elite here. If I do, what age does the buyer have to be? 18 or 21?

How would you know, by what age the buyer says he is?

More to the point, were you considering selling to a buyer in another state from you?

It doesn't matter. Shipping an automatic knife over state lines is illegal. So I certainly wouldn't worry about the age of the recipient.

Then why even sell on ebay, or have internet knife stores? I see hundreds of autos being bid on and the location of the seller and the bidder dont match. I also see online knife stores that will ship anywhere as long as its not illegal to own in your state, city, etc. Is that illegal?

Wait, then how am I able to send a knife to get repaired if its illegal to ship out of state? How do sellers sell on ebay, how do internet stores sell their knives? Do you have to be a dealer or something to do that?

Aye there's the rub, does the act of making something illegal stop the illegal activity associated with the object?

Check out the auto forum here, and pay paticularly close attention to the stickys at the top of the forum.

Autos are a tricky thing to deal with anywhere where they are not legal, let's not even get into interstate tranportation of the illicit item.

On a final note, the fact that it happens on the internet and ebay does not mean you or they are not breaking the law, it just means you or they have not been caught.

I own several autos legally within the decription of PA law, do I take a chance of breaking the law if I carry them out of state, I sure do, and as an adult aware of the consequences of my actions, I also am prepared to be held accountable for my decisions.

Basically, a dealer can ship an auto knife to another dealer across state lines. He can also ship an auto knife to a government agency that has issued a written purchase order. Shipping auto knives to individuals - any individuals - across state lines is illegal. It is illegal for people who sell on Ebay. It is illegal for an on-line dealer or any other dealer. It is simply illegal. Sorry but that's the law. Happens every day, as you know. But it's still illegal.

I have been told that autos can be bought by milatry, police and one armed men through the internet due to this exception:

Sections 1242 and 1243 of this title shall not apply to -
(1) any common carrier or contract carrier, with respect to any
switchblade knife shipped, transported, or delivered for shipment
in interstate commerce in the ordinary course of business;
(2) the manufacture, sale, transportation, distribution,
possession, or introduction into interstate commerce, of
switchblade knives pursuant to contract with the Armed Forces;
(3) the Armed Forces or any member or employee thereof acting
in the performance of his duty; or
(4) the possession, and transportation upon his person, of any
switchblade knife with a blade three inches or less in length by
any individual who has only one arm.

I live in a state where autos are legal as collector items but not to carry. When they break I take them to the store where the are sold and they send it in by private carrier. They indicated that you cannot ship autos by the USPS.
