what should I do??? case 6235 1/2

Hello friends,
I've just received my latest purchase a very very beautiful case xx usa 8 dots 6235 1/2
out of ebay, and it cost three numbers xxx.

The problem is it has some issues, and what I'm asking is your opinion about if I should return it to the seller or It can be fixed.
Some minor fit and finish imperfections:

and then the biggest issue:
the main blade has a very gritty and uncomfortable walk, besides what it seems to me a lot of blade play

if you look closely at the pivot zone you'll see a gap which results on the point of the blade travelling about 2 mm(don't know how much is it in inches) side to side.
I have seven days to contact the seller, so What do you think? Is It fixable??
should I return it??
I'm very sad and dissapointed because It's going to be my fiance's present.

How did the seller present it -- mint, excellent, good, fair, used, shows use, etc.??????

I see what you mean by fit and finish issues in the 4th picture but I don't consider it to be a problem especially for a used knife.

As to the tiny amount of blade wobble, give it a gentle squeeze.

Gritty walk -- give it a good wash in hot water, a thorough drying, and oil the joints.

I'd keep it.

As you see is not compromising.
 
So your'e the one. I almost went for that one. I would contact the seller.
The color on that knife is fantastic and a minor gap or chip would not bother me in the least. Then again I carry and use my knives. Very few safe queens. It would need a box to stay in the safe.

I also carry and use all my knives, and this one was bought to be always in my watch pocket.
I don't mind the little gaps etc. what bothers and concerns me is the wobble, I don't have much experience with slippies but I can see the blade play going worst with use.
The squeeze seems like a solution but I want to hear some more opinions before do something "undoable"
 
If it's going to bug you, I'd send it back and not give it another thought. I've got quite a few 1970s "dotted" Case knives and I don't think a single one has any blade play. The 35 1/2 and 31 1/2 patterns I have are all stoutly made and all have great walk and talk, and firm springs which IME is typical of Case knives from that era. That's not to say they're perfect though. It's not uncommon to see occasional gaps and even a spring that sits a smidge high. Again, if it bugs you now I think you'd be well ahead to send it back and keep looking.
 
2mm of movement at the tip of the blade is ~0.079 inch. That's about 5/64", about the thickness of a typical round, wooden toothpick (I just measured one with a dial caliper). I've seen much worse movement on blade play. As mentioned, a very gentle squeeze of the bolsters should snug it up, if it's really that important. I don't think I'd bother with that, on such a nice old knife like this.

I'd KEEP this knife; it's a beauty.

thank you for your answers.
I've been thinking about the matter all weekend, and at the end I decided to keep it, as you said is too nice to give it away.
After reading one of jacknife's stories (the lost stockman) where the grandad fix an old knife, I tried the gentle squeeze with my leatherman charge and a piece of leather protecting the bolsters and the blade play is now gone, then I cleaned it and oiled the joints, and now walks and talks as It's supposed. the only thing is now the rivet pin is a little bit out of the bolster but I only have to polish it a little.
I hold it in my hands all day long hehehe. It's really beautiful.
