Who here is from Canada or better yet from PEI? Knife laws help needed!

Hi there I live on PEI Canada and I need some help with the knife laws here. A while ago a fella was taken to jail and charged with carrying a knife. They never made it clear what he was carrying and why they arrestd him. So I would like to knife what knives are and are not legal in PEI or Canada. Also the legal blade length. Please help me out so I dont end up like that fella. Thanks Geoff.

P.S. There is no blade length law in Canada any more, that was dropped back in the early eighties

Check with Cliff Stamp, one of the moderators who has a section on his website dealing with knife laws and in particular has a Canadian Law section.

Hey Gunner...

Basic law..

No Auto, Gravity, Inertia, No Concealed, No large fixed blades in stupid places (malls, downtown)

It's pretty basic stuff.. It's all up to the officer who nabs you..
If you are a prick,he toss you for a SAK, and on the other hand,, if you are nice,, he might let a tactical folder pass. All depends where you are and what you are doing!

If you are shopping with a large bowie strapped down,, you'll go for a ride. Get caught with anything concealed,, same thing...

If you are hiking with an Anaconda in the woods,, No problemo....

I just noticed this thread and I'm afraid I won't have the time to answer in any detail for at least a few days. This is not an easy area of the law, even for lawyers and judges. It's even messier and riskier on the street in real life situations. Some of the basics were covered on another thread here about a month or three ago. If noone else remembers where it is, you can find it by scanning my previous posts, although that's unlikely to be very entertaining. In short, the topic is governed by the Criminal Code provisions regarding "weapons". The Regulations, which are reproduced in Martin's, prohibit some defined types of knives, but there is no general restriction against specific blade lengths. The most problematic sections are the ones that deal with concealed weapons and dangerous weapons, but to know the law on these sections you have to be able to understand the caselaw, which sometimes is contradictory, and you need a working knowledge of the distinction between actus reus and mens rea [very loosely equivalent to the distinction between action and intent]. The police have an enormous amount of discretion and if they are intent on jailing you it's best to be cooperative but to maintain a judicious silence so as not to incriminate yourself [ie, to say anything that can be misinterpreted later]. Then call a lawyer as soon as you can. I'll check back here later to see if you found that thread or got your answers some other way. Someone once suggested that the Forum have a specific section for questions like this. The AKTI might already have some information and commentary; that's probably where the other posts are.
