A knife incident at work (I'm semi-invoved)

Hmmm... why did you give an obviously irresponsible woman a knife anyway!?:confused:

I didn't mean to say she cut herself with it, I meant to qoute her as saying "richard and I were messing around, and richard cut me with it" what happend was, she was using it to cut a box open, richard said "let me see it" and he proceeded to try and open it with a wrist flick over and over. Finnaly, she said here just give it back when he did it one last time (successfully) and cut the top of her hand when she reached for it. I watched the video/audio of it all, and Richard obviously was handing the knife to her when at the last second he decided to give it one last flick. She is actually very responsible. She carries knives and is thoroughly trained in 4 different martial arts.

I almost -hate- people who don't respect knives because neglect often leads to harm to themselves and OTHERS.:grumpy:

So you give her a knife and she dobs you in to save her own cut neck? Not a good friend at all...

Just deny that you gave it to her. They won't be able to prove it unless it's on video.

It's a fast food job-- who cares -- they can write up the OP all they want to -- worst scenario you find another minimum wage job.

The employee handbook states that we are not allowed to be in possesion of knives at work. I never read the handbook

good luck finishing! once youre done you can get a job without such rediculous restrictions.

anyway, you probably will get a write up and thats that, but as far as being liable, you transfered possesion of the knife to her and she got cut by someone else so you seem to be legally clear (though I cannot state for sure since Im not a lawyer, so be careful about what you say) on that particular front.

take your writeup, ask for a copy of the tape and be prepared to find a lawyer (as long as you have the video even a cheap lawyer should be adequate).

dont fight the write up, just take it and apologize to your manager/owner and itll be over. part time people have done way, way worse in the past and kept their jobs so its best just to take it and keep working,
 
It's a fast food job ... it's a JOB. Tossing it aside because there are others is wasteful. He's got time there, experience, and friends. Stick with it, get through college, move on up after that. It's not a great idea to denigrate anyone's employment. Sure there's better, but it's always good to focus on what you're doing.
 
Ignorance of the workplace policies is not a legitimate defense. However, your supervisor may take that info under consideration of the offense.

Personally, I feel that it is a stretch to hold you accountable for someone else using am unauthorized tool and then having an accident regardless of how they obtained the tool.

The workplace is allowed to set their own rules for the use of tools in the workplace. It has nothing to do with legal issues of weapons possession. It has more to do with workplace safety and the company's exposure to worker's compensation claims.

The bottom line is that you make your case and then, if they force the issue, take the consequences for your failure to follow company policy--whether you knew about the policy or not.
 
In light of the new information, I would be direct with your supervisor. Tell them that you apologize for bringing the knife to work and will not do it again. I would think that it would not go beyond that.

This is of course assuming that "Richard" is not your supervisor, who then may wish to put the focus on you instead of his own ... irresponsible behavior with the aforementioned knife.

I hadn´t looked at it from that angle and I must say you make a very valid point, even if I stand by my initial conviction that, imho, a legal definition of a term should be binding. But hey, at least I learnt something in this thread. ;)

possation is 9/tents of the law it was clearlly said on the text THEY WERE MESSING AROUND sounds like they wernt doing there job and someone crybaby got a couple of stiches fire the crybaby 4 being messing around just my thoughts
 
The job is nonesense. Thank the person who wrote you up, tell them you didn't know the rules, and your glad they set you straight. Just make sure you don't get nervous and spill hot grease or oil on them. A very comman occurance in a restaurant. Be careful you don't spill grease on the floor where they walk either. Accidents can happen and someone nervous because they got written up, can cause an accident. That would be a shame.

A lack of respect for other people's jobs shows a complete lack of understanding of the interdependence of modern society.

No, all honest work is equal in dignity.

It may or not be easy to get another job, but he has made himself a place where he is, is developing a stable employment record, and has friends to work with. New job, start from scratch. Not a major problem, not a necessary one, either.

Try living in a small town where one of the factories goes teets up and sends hundreds to the unemployment office - you'd be amazed how coveted even a fast food job can be. Happened to me once, back in the day. Couldn't even get a job in fast food, and was stuck doing tech support.
 
Seems like this Richard charachter will be getting the brunt of the blame, he was in possesion just as you were, but he pretty much assaulted a woman with it.
Just play dumb and think twice before doing such a favour again, no good deed goes unpunished.
