"MT Whaleshark Perfect blade. Never been used or sharpened. Only deployed several times and put on display in case. Looking for Emerson Gentleman Jim, MT Vector, or any other Emerson Knives as long as they are in reasonable good shape. Will also consider anything else tactical that has been customized or pimped."

I had an email exchange with this guy, offering a first-run Brous Reloader with all the goodies in exchange for his Whaleshark. He continually assured my of the quality / condition of the knife, but when I got the knife:
- Vertical blade play, to the point that it rattles when even lightly shaken (lock bar didn't actually engage on the tang!)
- God-awful detent
- Loose pocket clip screws
- Extremely dull blade - the blade actually hits the back liner, and was uniformly folded over.
- Oxidation on pivot and thumb studs
- Chisel ground, which was not stated at any time.

I had also sent mine fully insured, and he sent his Fedex 2-day uninsured DESPITE agreeing to insure it as I had. I contacted him about how dissatisfied I was with his conduct and dishonesty about 11 days ago, and he has not responded. I have since sent the knife off to Microtech for warranty service, which cost me a good $20 that I should not have had to spend.

Avoid californiaDog / Andrew Stewart, Esq.

Comeuppance,

An attorney that misrepresents...I am shocked!

In all seriousness, Sorry for this bad deal you are involved in. My question is why did you not insist that this individual ship first? He has zero feedback.

Hope you are able to undo the deal

Funny you would mention that.

From the email exchange:
"The only thing I ask is that we dont have some stipulation that I send my blade first and then when you get it, you will send to me. I literally have been burned all 3 times I have ever done that and am unwilling to even entertain the thought. We have to share the risk and send them out and provide a tracking number to the other for peace of mind. "

To which I responded:
"I've never been comfortable with such arrangements - too risky, and not just a little insulting to ones character. I actually almost got burned on just a regular sale - I dropped $400 on a Z-Wear Strider and the guy never shipped. I ended up tracking the guy down and informing him that what he was doing was mail fraud and thus a felony. That didn't get a reaction out of him, so I had the police visit his house. Turns out he never had the knife. He bought one and sent it to me after that."

An excerpt from my so-far-un-responded-to most recent email:
"Ironically, in this case, I apparently SHOULD have asked you to ship first, because this is a [expletive removed]-show of a trade and now you have my (considerably more valuable and in better condition, all things considered) knife."

Un-doing the trade would be a huge loss on my part at this point. After the insured shipping, shipping the knife to Microtech, and then shipping it again to him, I would have effectively spent over sixty dollars to fix someone else's knife.

Attorney Andrew Stewart is an ambulance chaser here in San Diego. Here is business email address & a link with his picture & phone number:

Thank you for the head's up- California "Dirty" Dog, Andrew Stewart is now on my BladeForums never to deal with list. I hope that Microtech corrects the issues that weren't disclosed (Attorney/BF seller privilege) by Dog.

This is the second dishonest lawyer so far. I'm beginning to think this is a trend. If he's making $20K in a couple hours, why oh why does he not get himself some glasses? He obviously can't even see what knives he is trading

A thirty second Google Fu can help avoid days of headaches; especially easy if the search name is less common or you have other identifiers before the transaction is finalized.

According to the California State Bar Association, he is no longer eligible to practice law.

He had a Disciplinary Action and Suspension, and subsequently failed to pass the Professional Responsibilities Exam:

Good Luck

Well, in a nutshell, there you have it: "Andrew Stewart wins a $2 million judgment for his client, has financial problems, uses his clients trust account for his own needs...AND, he suffers from bipolar disorder...

California Bar Journal Discipline Summaries
In mitigation, he had no prior discipline record, demonstrated remorse, had severe financial problems and he suffered from bipolar disorder

Moral to the story: Don't let a bipolar attorney with financial problems, play with a new/mint Microtech Whaleshark knife!

Best of luck, Comeuppance!
