If you change 2 words in this foolish sentence you can see how it could easily be any other Amendment in the Bill of RIGHTS!! Change the words second and gun and replace with first and public. Now you get.

i don't want to get too technical, but that sentence is true as far as constitutional law is concerned. you don't have any right, constitutional or otherwise, that cannot be reasonably restricted in some way.

obscenity is not protected by the first amendment and neither are "fighting words."

if the second amendment were totally inviolable how would the state limit private possession of hand grenades, flame throwers, rocket launcher, and tanks?
 
Flame throwers are legal in some states. They are not very good weapons and are most often used in agriculture or by hobbyists. Your restrictions on the Bill of Rights just allow for further infringments by people saying that something else is obscene or offensive. IMO the only things that should be considered fighting words are direct threats. Anyone who can be manipulated to violence by mere words is pretty pathetic IMO. The Bill of Rights are restictions on what the government can do. The problem is that most people have forgotten the true role of our government and now we are on the road to a police state.

On the original topic, this law sucks and those who made it and enforce it should be arrested for crimes against freedom.:D
 
This, unfortunately, was bound to happen. Now Kershaw is going to have to, like it or not, invest vast $$$ to protect it's position. This was an accident waiting to happen.:(

Better question: Why does the state NEED to limit private possesion of hand grenades, flame throwers, rocket launches, and tanks?

Their use as weapons is already illegal. I don't see why possesion needs to be.

The military has access to much more deadly weapons, yet I don't see them going on a rampage, killing civilians.

We let 15 1/2 year olds get behind the wheel of some pretty dangerous weapons. Lots of other civilians have access to things that make rocket launchers seem pretty tame.

Back on to the subject.

As for switchblade laws - Offhand, I can't think of a more unreasonable restriction on technology.

At least the assault weapons ban tries to prevent the all too common drive-by bayonet attack. :rolleyes:

The opening mechanism on a knife does not make it more dangerous. It cannot kill, maim, or hurt any better because it opens with a spring.

It takes far more time to deploy and open a switchblade than it does to deploy a fixed blade.

Yet, in many places, while it is a felony to posses a switchblade, it is both legal and acceptable to carry a fixed blade concealed.

Why should the government be able to legislate how a knife opens? Why do we need so many laws about something so meaningless?

The SAT/speedsafe mechanisms are slick, and well executed. But, basically, they are switchblades built to jump through legal loopholes.

I wouldn't be suprised if the switchblade laws are changed to eliminate them. And, it's not going to happen at the federal level. Probably not even at the state level.

Instead, it's going to be at the county and city level.

Stupid, stupid laws.

And, if the laws don't change, it's going to be how the DA's interpret them. Either way, I foresee them being banned in unreasonable places.

Keep in mind this is only 1 DA's opinion and not state law. In Dallas county those knives are considered legal. Get enough people to call this DA and let them know how you feel and remind them about election time and see if she still wants to tote this line. I have talked to the DA here and several surrounding counties and none of them would consider those class of knives as illegal.

Does no one else here realize this? News flash! It's ILLEGAL to even speak the word "president" or "senator" or talk about politics at all unless you do it exactly when and how THE GOVERNMENT ALLOWS IT. Thank you to all the liberal Democrats who made this possible. Then end of freedom has begun.
 
it is not that bad yet Possum. You can still get pretty close to G.W., call him a **** and flip him the bird and both acts are constitutionaly protected. Not that I get many chances to give him the Texas howdy, but our Federal Government is not that bad.

the larger issue looms with State Governments. Just execute the appropriate Federal paperwork, pay the right taxes and you can own that tank or rocket launcher. It's State Laws that infringe on our rights. [Ma. for example]

It's the morons that get elected to respective State Houses and senates, couple with soft-headed judges that has made it legal to drive down Main Street in anytown, NH towing a Howitzer but a crime to have a dagger or dirk in one's pocket.

Uhhh... Yes it is. I take it you're not aware of the specifics in the "Campaign Finance Reform" bill that became law November 6, 2002. Yes, you can still flip someone the bird. But it is now ILLEGAL for citezen's groups to band together to buy airtime and talk politics 30 days and 60 days before elections. You cannot refer to a candidate by name, mention his voting record, anything meaningful. It banned speech that the first amendment was specifically designed to protect. Now, if his majesty doesn't like what you say about him (even if it's perfectly true and harmless) he can throw your ass in jail.
 
Does anyone know what the process of law is in this case of a DA applying a law as she interprets it? If a citizen/group challenges her in court, the courts would HAVE to hear the other side correct? Like if a store refuses to discontinue selling the knives and gets tossed in jail or fined, Kershaw and the store would then be able to defend themselves in a court of law?
 
I expect this from Kalifornia but TEXAS!

Hell under Kalifornia law the Chive and scallion are perfectly legal.

By the way, under Texas law you can legally carry a shotgun or rifle in your vehicle, but having one of these "dangerous" knives in your vehicle could land you in jail.
 
I am not sure if this was already addressed. Kershaw got away with selling their Kershaw Speed Assist knives because they do not use a spring. Unlike a switchblade, the Speed Safe technology is a torsion bar that when force is applied the momentim of your pushes triggers the torsion bar to finish opening the knife. There are no springs, buttons and you have to physically touch the blade. Also, as mandated, the torsion bar not only opens the knife, but is done so it also pulls the knife closed when it reaches a certain point. At least it does on some of the Kershaw knives. These knives are copletely legal and in moh I believe that switchblades should be legal also, as should any automatic knife. I pray that not all states will be corrupted because when I can move from CA i am outta here. Probably to AZ or CO. I would fight this as high as I could get it, personally.

Like the post above by kershaw72787, if I leave CA in the next year or two, it will be because of the crazy politics and high taxes.

My boss would probably love it if I brought up the idea as we're based in Los Angeles, but are doing a lot of business in Phoenix these days. I could become our Phoenix office. I'm a sales rep and work on the road from home most days anyway, this would just save a 6.5 hour drive every so often.

In AZ, I could have a CCW and an auto Socom in my pocket. In CA I could go to jail for years for carrying these things around.

This makes me knuts!

I completely agree with you, I love reading the posts on this site. The views are so refreshing, as to being fed all that Right Wing Liberalist Hogwash by the news constantly, not all the news is bad but they are definitely slanted on some issues. It is just nice to sit down and read things by people who agree with my views. Thanks.
