BM 42 problems

Okey doke, I got two BM 42, one is gold, the other has some problems. One is that it pinches my fingers a lot, I mean I can shift my grip a bit and it's fine, but it pinches my thumb while the other doesn't, when I'm jest messing around. The other, more serious problem, it that there's a lot of misalignment , to the point where I'm comparing them to my cheapo imported ones.
I tried tightening the screws, but to tighten the handles but to eliminate the wiggle the handle won't flip. grrrr... HELP
 
Yah i thinkt the warranty should cover that as a defect. While were on this will they fix a blade by any chance.
Also gold 42, sounds different.
 
I guess it's back to benchmade it goes, I hate to do it and be parted with one of my babies:( , but all is well that ends well. oh sorry for the confusion, when I said gold, I meant golden as in it's a wonderful knife.
 
I have the same problem. Sending it Benchmade wouldn't be a problem for me. Getting it back will be a bit difficult. :(
