i am not sure how the scratches got on there but it was never carried or used to cut.

I have the same knife and my blade is perfect, even having cut some stuff with it. The blade doesn't touch the inside of the handle when it's closed, or at least it shouldn't.

From the looks in the picture, there's no way that blade is unused, IMO.

Did you buy it new or did you get it second hand as a "new" knife?

Looks like an inner frame rub to me, its all along the top edges

It couldn't possibly be any kind of frame rub or wear. The blade doesn't go that far into the handle when closed.
