Boss called me today..........

You may or may not know that I have been off work, due to having surgery on my left elbow; I had an extensor tendon tear. Then I had another pop in my elbow. Things just aren't going well. I HAVE been going to PT. When I had another pop, she sent me back to my doctor. Anyway.............fast forward to today. I get home from PT (She is sending me back to my Orthopod.), and there is a message from my boss to call her back. I call her back. She tells me that since I can not come back to work on Monday, they are posting my position. She needs to fill it. She said she will be mailing me the stuff out of my locker. She said that I am welcome to apply for a position, if they have one available.I need to send my badge back as well. For those of you that don't know, I am a Surgical Technologist. I am shocked. But, I also believe that everything happens for a reason. Anyway, thanks for listening.
 
I am sorry to hear this.

Have they truly followed proper procedure? It's hardly your fault you cannot work yet.

While I'm sure you can find another posting, it would nice to know they've given you your rights ... and are not just thinking narrowly of themselves.

I don't think that you can be terminated for having become injured. I would check state & federal laws or have someone check for you. I'm pretty sure that what they're doing to you is illegal under federal law. You have my sympathy and hopefully right will prevail.

It sounds fishy to me as well. Perhaps by saying that you can reapply for something else they are covering their behinds?

The bar in our State has a service where a person with a legal problem may call, speak with a liason and get a referral to an appropriate attorney to discuss their problem. The consult is for 30-60 minutes(?) and the cost is very low, about $25.

The lawyer can tell you your rights, write a letter, etc. We have had VERY good results with this service, esp. in the area of employment law.

Sorry to hear that. Sounds fishy to me as well. Talk to someone in HR/Benefits and sort thru any medical benefits info you have to see what your rights are. You could also try your local Dept of Labor for your State maybe. Best of luck. I got "downsized" in Dec.
 
I think your rights have been abused, check it out, good luck with results or new position, perhaps it will be your former boss'.

I wish you the very best in healing back up and finding something else. You're right, everything happens for a reason even if the reason seems really difficult to see right now.

You're actually not in a bad career field to be in in these times, I recon. People still need to go to the hospital and have surgery afterall, even with the downturn in the economy.
Your boss is not axing your job, she's re-filling it because she needs someone badly. That's actually GREAT news! That means your job is still looked after even in these tough times.

So go out job hunting after you're better and keep a positive attitude, you'll find a better job soon I'm sure!

Oh BTW, don't know if this is of any help, but just the other day I heard from someone VERY much in the know that if you want to really get a job don't send your CV via email or fax, go there knocking on the doors in person.

This is not good news.

Personally I wouldn't fight it, the last thing you want is hostility between your boss if you got the position back. Hopefully it works out and you can find some income and something to do.
 
There will be a better position for you elsewhere. Keep the faith, and you will be rewarded for remaining strong in times of trials. You are being pushed elsewhere. "If you want to make God laugh, tell him your plans." is a favorite quote from a recent movie, and it is always relevant. Prayers your way, stay strong and you have support here.

Sorry to hear of your bad situation. This sounds completely wrong on their part, but there seems to be a lot of that going on. Hang in there. We all seem to get the shaft at some point or another. Been there! :(
