California OTF laws

Hi all,

I recently purchased an OTF that has a blade inch of 3.3. From my understanding, it is ILLEGAL to have it around in public which is perfectly fine but legal to keep it in my home. This will be a novelty item for my pleasure, which will be kept in the safety of my home. So I do not plan to have this ever in public. Which brings me to my second issue. I order the OTF from bladeops, and they only ship via USPS. Will there be any issues with me receiving it? I have read many people have been able to also receive the same product in California without any issue. If anyone could give me their personal experience living in California and have OTFs shipped via USPS that would be splendid or anything on the lines of BladeOps shipping OTFs to Cali. I have purchased many OTf's via mail (foreign and domestic), and have received every one of them successfully.
 
Since this thread has been resurrected, Can one in California legally purchase online and keep in the house something like the Kershaw Launch 8? I am aware it is not to be carried. Or does the <2'' blade limit apply for owning as well?

Owning any OTF and having it stored or displayed in your house is legal, carrying it on your property may be a gray area (if it is over a 2" blade length).

According to the Kershaw website, the Launch 8 is a side-opener with a blade length listed as 3.5" long.

Based on my study of California's switchblade laws, and my own interpretation, it's not illegal to receive one or purchase one (like ordering one from an online vendor). Notice how there is no mention in this statute of "receiving" or "purchasing" a switchblade- https://www.leginfo.legislature.ca....aySection.xhtml?sectionNum=21510.&lawCode=PEN

As far as what you can do with a switchblade in California (with a blade 2" or longer), just as WValtakis referenced, you can posses them in your home. You can also transport them in any part of a vehicle except the driver/passenger area.

But when it comes to carrying a switchblade (blade 2" or longer), there is case law that says it's illegal to do so even on your own property (People v SC 2009). In that case the California Appeals Court ruled that carrying a switchblade on your own property constitutes a violation of CA pc 21510 linked above.


On a related note, I would have responded to your post earlier, but I was busy making parts for a switchblade :) .
