Can I legally purchase a auto from Bladehq?

I'm a civilian living in California, is it possible to purchase it off Bladehq? It is a Benchmade 9052 that I want, just as a collector's piece, I know the law concerning carrying and ownership but not buying one.

If not, where else can I buy one?
 
I cannot say for certain for CA, but I ordered one no problem in OH. I believe they go by the federal laws regarding switchblades. As long as you do not sell it you should be within the law to own it.

Read up on federal laws regarding Interstate Commerce on auto knives (switchblades)

It would be a felony
 
And I say, have at it. Screw these corrupt and unconstitutional laws! Laws are made so by people OBEYING THEM!! There was a time that men would sacrifice their lives, and take others, to beat back laws such as the ones we are living under now. Who, in their right mind, would ban a knife because of the way it OPENS!? It simply does not make sense!!

But hey, if you can live that way, who am I to tell you what to do................

if that is so then all of the American knife company are breaking the law. every one on the knife auctions sites are breaking the law.

That "all" is bit sweeping, and incorrect.

Of manufacturers, for example, Sypderco, Benchmade, ProTech follow the strictest interpretation of the law in who they will sell to directly.

Some dealers interpret the laws differently. I asked one very reputable large retailer about this at Blade a couple of years ago and was told their attorneys had reviewed their practices and they were confident they were on firm legal ground.

Other dealers take a very strict policy. For example, Knife Center and New Graham are very strict, requiring you provide proof of your LEO, military, etc. credentials to purchase.
 
Yes it is illegal to ship interstate, and even shipping to a member of the service or law enforcement directly is illegal as only the procument department is allowed to order accross state ilnes. Do many many dealers break the law ? Do some of their lawyers tell them to do it anyway? Yes. Lawyers get paid to adivise and even more to defend in court.....The law is seldom enforced, but if it is then the charge is a serious one.
 
I read somewhere on BF recently that you can legally have the knife sent to a local authorized dealer and purchase it from them.

EDIT: After reading the law linked to in the above post it seems unlikely that this is true.

let's see. the world is going down the drain and they want to force this stupid law?? the post office can not make the money just to pay there retired people so we are going to stop sending are switchblades threw the mail and there goes that money too.

The law has been on the books for decades, it's nothing new. I doubt the number of knives that aren't shipped because of the law has little bearing on whether or not the post office can pay their employees.
 
Rich, You always have one way of looking at it....Law enforcement could say, they could charge you a LARGE FINE for breaking the law and therefore make lots of money.....Spyderco paid over $400,000 in cash and lost items......It is the law, so obey it or consider yourself a criminal and break it understanding there could be both fines and jail....I hope the law will be changed and the best thing to do is SUPPORT Knife Rights as they are getting many state laws changed, and they were very successfully with Customs and what they will allow in. Remember as with ANY LAW, the best way to deal with an unfair one is to work LEGALLY to change it rather than breaking it and by definition making yourself a criminal. If you break a law that is defined as a Felony ( more than one year in jail as a punishment), then you are a Felon....Getting arrested and convicted just makes you have a record and be punished but breaking the law makes you a felon. People get that concept when it comes to murder and theft, but they often choose to ignore it when they don't like the law they break...
 
Very well stated Tom. Being a "rebel" and having a rebels attitude doesn't do a thing aside from endangering the individual.
 

I read it on the internet news of juno and they are in the red paying for them. at lease that is what the news said. almost everyone that is selling switchblades and all of the USA companys are shiping across state lines unless you are telling me benchmade has knife factorys in every state that they sell them in are breaking the law. all of the china switchblades are getting across state lines.

You can read it and see just how serious a crime it is......Using the Post Office for either delivery or payment ( or both) just adds a few more crimes.....

Looks like section 1244 (1) of the law could be a potential loophole, and perhaps a good reason why out of state sellers are able to ship.

I know it only applies to common carriers but, sometimes a small loophole is all that is needed.

I wonder if the law was designed more as a means of prosecuting people who try to buy large quantities at a time and flood the streets with them.

I've had 5 autos since 1986, and all were bought via mail / online order. Of course someone did already mention that Ohio is pretty laid back.

yes but not all of the state are laid back like that. there must be 5,000 people or more shipping there switchblade sales by the post office. now you are telling me that the goverment does not know that they are shipping them by the mail??
