Strictly speaking, yes. Most cops I know are pretty reasonable, and will recommend that any "worked in" knife like that be tightened or retired.

That has been tried in Quebec, actually. Not too too long ago, their highest court ruled that balisongs did not fall under the description of "gravity knife" as described in the current legislation. That lasted all of about a week - a federal court overturned that decision.
Also, proving a law to be silly, no matter how you do it, is not going convince those responsible for it. Even if statistics were gathered, just for the purposes of exempting this one style from the "gravity knife umbrella," it wouldn't work. Stats only work to make new law, not change or eliminate old ones.
