The e-Bay people can't shut an auction down because one of us say it's a fake.

They can only shut it down if they hear from an authority--and that means the Buck Company itself.

If e-Bay shut down auctions based on accusations from the general public they'd lose a huge amount of money and also get sued a fair amount for wrongfully closing auctions.

There are lots of sellers who try to shut down their competition by falsely claiming various and sundry illegalities in their auctions and e-Bay does spend a lot of time investigating them--but an opinion from you or me that a particular knife is a fake will carry no weight whatsoever.

You can (and should, if you have the time) harass the sellers of obvious fakes as Plumberdv does.......but it won't make much difference in the long run. The fakes are out there and will keep turning up on e-Bay.

You may succeed in one way......and that's in getting them to perfect their fakes to the extent that nobody can tell they're fakes without a lab analysis of the steel.

Another forum member who is an expert pointed out why ebay might not aggressively pursue counterfeit auctions: Someone who has a genuine item usually only has one to sell, but a counterfeiter is steady, repeat business.

Second.....why do you "take it?"

Have you found the e-Bay TOS to have a lot of application to the way things really are? I've found that real-life experience is far better. However, if you have anything useful from the TOS--please share it with the rest of us.

As far as I know, we don't......so we have no argument that I know of......unless you're trying to create one.

The eBay TOS gives eBay unbridled discretion to remove a listing for possible infringement of a mark:
Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and their content, services and tools, delay or remove hosted content, and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies . . . .

Your description of how eBay behaves is quite accurate. EBay could behave otherwise.
 
I think Tom (skyhorse) got the fake Striders shut down by spamming eBay about their irresponsibility in letting them sell counterfeits. It doesn't appear from looking that the seller himself stopped the listings. They were just removed and no longer even show up as completed listings like the ones do that I got the sellers to shut down. If you do a search for their item numbers, they no longer exist except for the ones that sold.

E-Bay doesn't much care if one of us thinks they're irresponsible. They get far worse insults thousands of times each day.

Regarding "fakes".......

Read up on e-Bay's VERO program.

It's possible that Buck may have reported the auctions and then they would be pulled.

I have suggested several times that Buck become a VERO member, but they don't show up on e-Bay's list of VERO members. That could simply be because they have not opted to be on the published list. I see the Reeves people are on there, though.

It's also possible that e-Bay took a look at the auctions based on other complaints and pulled the auctions for other violations not related to the "fake" issue.

A lot of bad sellers have other problems within their auction that can justify e-Bay pulling the auction because of policy violations. Just saying that a knife "might be" a Buck or is "like" a Buck, etc., is a violation.

Fact is, plenty of auctions go on with policy violations all the time. There are too many to check.

If you've noticed, a lot of the questionable sellers have been using short auctions (Three-Day or even One-Day) because they are racing to sell quick before they get shut down.

I think it's great to get after the bad sellers, but be sure and stay within the rules so you don't get in trouble for harassment......and don't think you can ever fix the problem. It's permanent.

Yes, e-Bay is pretty mixed up and messed up right now. That's why I only buy and never sell.
