My step dad wants me to make the gap smaller because nails can get through it now. my question is after i heat it and re close them for lack of a better term, should i heat treat them or what cause he said i dont want it to lose the "temper". do these things even come with a temper? Thanks
 
Yes you will need to re-HT the entire crow bar. however w/o knowing what kind of steel it is, it's a crap shoot. and having done that to a crow bar before, trust me when I say it's more then certain to fail. Crowbars could be anything from L6, to 1050. to case hardened mild steel. do him a favor and just buy a new crowbar lol, good luck

Would it be easier in the long run to regrind? Shorten the "teeth" (or whatever you call the business end) and remake the notch?
 
I don't think you would need to re HT the whole thing, take a short local heat on the end, give it a couple bumps to bring it tight again then dunk in oil, torch temper to a dark blue. This should cover everything in a safe way, crappily but then you don't really know what it is so better to be safe.
